yomuwinta aug 17 the contest for prothonotary in thii campaign in our county ig among three principal contestants — the present depu ty cspt win m mcelhaney of lower merlon erf whom i have already spoken through your columns m s kulp of telford and henry w retff f lower snif'mii tlir latter lavs hi claims to the office ii tin ground that n the last election it wm decided by the people that lower salford ihonld have it this term george p alderfer therefore was nominated nnd elected bui died before being inducted into office thai merely because alderfer died the township did dot thereby lose her right to a bill offlge so loos postponed — she never having had any office in the court honse nnd that he and his father jamb 8 keiff have always been ardent republicans mr knlp claims it on the ground that he was promised it last year but was laid aside for cieorge t alderfer mr keiff is a storekeeper at lederachville in lower salford is about 32 years of age and is in every respect a man of unex ceptionable character the forces there fore in the upper end will be divided between kulp and keiff upon their re spective merits as men ana with retard to locality the latest discovery among the bad acts of the last legislature is the vicious cheese law if they could not pass a law on any other subject it was supposed that they certainly could cheese it on this but it was not in them to draw a bill correctly even for cheese another farmer in plymouth township has fallen a victim to accident alan corson egbert was nearly killed on tues day of last week by falling from a load of hay alan is a very worthy man he is a blacksmith by trade and for 40 years he was foreman in the shops of schall's iron works in xorristown re siding just outside of the borough line he walked or rode every morning from his little farm in plymouth to the mills in norristown and back every evening managing his agricultural interests all the while he has reared a large family and has a beautiful home but now at the age of 75 he finds himself crippled and helpless by accident ! the assassination of canovas premier of spain shocks tin civilized world like that of garfield and lincoln in our own country we are falling upon evil times times that remind us oi the days ot rome when htmls went off of trembling kings and assassinations wore common things next tuesday the democrats will meet in county convention in the court house and jacob r yost chairman is busy in arousing his discordant cohorts to action perhaps their very differ ences and desperation will drive them to some sensible declaration upon which all elements opposed to the republicans and their boss rule and especially the work of the last legislature may unite the silver question seems to be settled a tariff bill has been adopted and now is the time to pay some attention to the affairs of state without regard to names and titles of parties party names are often a bugbear men will not march under certain old standards to which they have long been opposed if the people could meet like they did when they agreed upon the declaration of in dependence and stand for country and the country's good without regard to all past differences then we could see the dawn of the millennium the silver craze was the entering wedge for the division of the old democratic partv slavery for the dissolution of the old whig party and insolent boss rule and an ignorant and corrupt legislature for the throes of the republican mother out of all this corruption and fanaticism may come something to make the penn sylvania name honorable just as the bicycle craze has made all tramps re spectable it is a great leveler the effort to make the last sunday in may memorial day should succeed sun day is the proper day for such proceed ings i have advocated it from the be ginning xqw i rejoice to see that at the 3ltt national encampment of the grand army of the republic to be held at buffalo the question will take on national importance and be discussed with the view of accepting the last sun day in may as the proper day for the observance of strewing flowers on the graves of the soldiers i delivered the first address at the first observance of this beautiful performance in montgom ery county and it was on a sunday the day should never have been changed lunacy casea have become tjuite a bus iness for lawyers and commissioners in our courts during this year already the following have been adjudicated lunatics ella alexander cornelia vic toria beerer florence butler enos c'as sel annie jones cameron agnes cotter michael collins annie coreuus wm dwyer james dunn george b detwei ler win j doyle joseph w davis bdwan dougherty ruthett eckert hiram fulmer mary frederiok frank fluck david gilbrot saundeif and june e wilson and one oaw pending before a commissioner making 80 in all this shows one great source of power placed in the hands of the judges for in each case the judge must appoint a commission consisting of three persons — ojm lawyer a layman and a doctor if the judge should be partial and haw hi favorltes lor appointment he could af ford a lawyer a luviuun i a ii<n>tor a very handsome little side revenue during the year tlu cases rarely occupy much time in the trial for it is seldom that u alleged to be orwy or imbecile unless the testimony is very clear then tho divorce cases in which 11 commissioner i-s appointed in eaoh oi uae i u an element ol power and of pat ronage in the court and last and important than all the appointment of audu an unthinking or rather unretlocting though perfectly h mi t jndgecnn ensilj fall into the habit of selecting lawyer wit bout referen * to fairness to the whole lmr appointing certain ones continually to distribute the largi t nnd most con tested estates in which there are always the largest fee nnd now and then once | in a year or two throwing the small i tates around among the nnfavored and forgotten ones it would make an interesting article in itself to show exactly what has been iii the court in these matters not only lawyers are interested intheorders appointments and rules of the court but publishers aleo for the times-chronicle of jenkintown in an editorial last week call attention to a rule of our court compelling all auditor's notices pro thonotary's clerk of the court sher iff's and others to lie published in the montgomery county law reporter a little court journal published in norris i town and circulating only among the judges and lawyers all notices affecting people in any lo i caiity ought to be published in a news paper issued in that locality the ad | vertising and the audits should be fairly and equitably distributed in some es tates the auditors gel 20 to fsoo while in others they get but 1 yet those who get the biggest fees as a rule get the most audits the same way with adver tising the very cream of it goes by an order of the court to a paper that has the least circulation in the county j commissioners in lunacy cases get 5 | each in every case and thus the power i and patronage of the court is enormous the court has also arbitrary power in granting and refusing licenses and di vorces power to strike one man down and destroy his property power to build i another man up and give him a rnonop i oly in all cases of trial by jury un people are represented on the jury and therefore they can take care of them selves and give every man a fair trial law questions are settled by legal j principles they are properly referred to the judges lor if our judges be in error they can be reviewed in the su preme court and corrected but in all the other matters that i have referred to the judges have arbitrary and uncon trolled authority this is a mighty pre rogative it is like the power of the king described in esdras so far as the subjects over which the judge and king ! respectively bear rule and ve't he is but one man if he command to kill they kill if he com mand to spare they spare if he com mand to smite they smite if he com mand to make desolate they make deso late if he command to build they build if he command to cut down they cut down if he command to plant they plant the judge has also arbitrarily , the appointment of all road and bridge i viewers and if so disposed has it in his j power to favor his friends and punish his foes much of the tyranny of the old world has been engrafted into our laws perhaps we may never outgrow • it or get rid of it in the new states the people have retained more power in their own hands iii many states the i jury even fix the sentence that must be ' imposed upon a convict ( mil flilkxii oreland a valuable horse belonging to c d stout was taken sick on saturday with pinkeye but is revenue during the year tlu cases rarely occupy much time in the trial for it is seldom that u alleged to be orwy or imbecile unless the testimony is very clear then tho divorce cases in which 11 commissioner i-s appointed in eaoh oi uae i u an element ol power and of pat ronage in the court and last and important than all the appointment of audu an unthinking or rather unretlocting though perfectly h mi t jndgecnn ensilj fall into the habit of selecting lawyer wit bout referen * to fairness to the whole lmr appointing certain ones continually to distribute the largi t nnd most con tested estates in which there are always the largest fee nnd now and then once | in a year or two throwing the small i tates around among the nnfavored and forgotten ones it would make an interesting article in itself to show exactly what has been iii the court in these matters not only lawyers are interested intheorders appointments and rules of the court but publishers aleo for the times-chronicle of jenkintown in an editorial last week call attention to a rule of our court compelling all auditor's notices pro thonotary's clerk of the court sher iff's and others to lie published in the montgomery county law reporter a little court journal published in norris i town and circulating only among the judges and lawyers all notices affecting people in any lo i caiity ought to be published in a news paper issued in that locality the ad | vertising and the audits should be fairly and equitably distributed in some es tates the auditors gel 20 to fsoo while in others they get but 1 yet those who get the biggest fees as a rule get the most audits the same way with adver tising the very cream of it goes by an order of the court to a paper that has the least circulation in the county j commissioners in lunacy cases get 5 | each in every case and thus the power i and patronage of the court is enormous the court has also arbitrary power in granting and refusing licenses and di vorces power to strike one man down and destroy his property power to build i another man up and give him a rnonop i oly in all cases of trial by jury un people are represented on the jury and therefore they can take care of them selves and give every man a fair trial law questions are settled by legal j principles they are properly referred to the judges lor if our judges be in error they can be reviewed in the su preme court and corrected but in all the other matters that i have referred to the judges have arbitrary and uncon trolled authority this is a mighty pre rogative it is like the power of the king described in esdras so far as the subjects over which the judge and king ! respectively bear rule and ve't he is but one man if he command to kill they kill if he com mand to spare they spare if he com mand to smite they smite if he com mand to make desolate they make deso late if he command to build they build if he command to cut down they cut down if he command to plant they plant the judge has also arbitrarily , the appointment of all road and bridge i viewers and if so disposed has it in his j power to favor his friends and punish his foes much of the tyranny of the old world has been engrafted into our laws perhaps we may never outgrow • it or get rid of it in the new states the people have retained more power in their own hands iii many states the i jury even fix the sentence that must be ' imposed upon a convict ( mil flilkxii oreland a valuable horse belonging to c d stout was taken sick on saturday with pinkeye but is getting along nice'ly messrs
