ll'uv er'n ufe in xorrlstown passing of n ^ treat man norristown pa dec 23 1901 we hear much of a troublesome sur plus in the treasury at washington amounting now to 40,000,000 for the current fiscal year and it is anticipated that it will reach 100,000,000 by the 1st of july next and by the end of harvest to over 200,000,000 and what shall be done with it why only n week or two ago we were informed from washington that the administration had anticipated the interest due the first of january next on the public debt by paying it now it amounting to nearly $•">, 000,000 if 5,000,000 he the interest what must the principal be a school boy could calculate and ascertain the principal debt if he were given the rate percent which can not be exactly and truly as certained by any system of ratiocination because there are different loans am the rate per cent of interest varies on each but the fact that the government has this enormous debt on the one side and a surplus of revenue on the other renders the solution easy as to low to dispose of the surplus take it and pay off that much debt that is an easy one so long as the money is on hand pome enterprising congressman or cab inet officer or adventurer may soon dis cover a scheme for its disbursement on some new adventure perhaps for the survey of another route from the gulf of mexico to the pacific coast that would about take the forty and the in crease vill soon take wings and fly away the isthmian canal will never be celebrated in song as the raging canal of the schuvlkill was in olden times but it will rather be known as the canal that needs assistance the ca nal to be that meets resistence and ever is to be but never will be built in — our day our doubts are traitors and make us lose the good we oft might win bv fearing to attempt " our peo ple bliould have taken the tehnantepec survey across the southern line of mex ico and then it would have been an american highway across the territory of a sieter republic life he is very aged he was princi pal professor at freeland seminary when i first met him as my preceptor among my colleagues at that time were miiuiv who are now no more but among the survivors are wayne mcvaugh and other lawyers and business men mr sunderutnd afterwards became the found er of the pennsylvania female college at freeland now called collegeville from which he retired after a long and successful career having educated and graduated many women bud he unfor tunately engaged in a private banking business which wrecked his fortune and he is now suffering not only from de mentia but down the caribbean sea if the latter should ever be adopted it would not be 10 years before the people would clam or for the former just as they now urge a canal anywhere to avoid sailing clear ground south american north of the nicaragua route is nicaragua san sal vador honduras guatemala and the gulf of mexico before you reach the mouth of the mississippi another holiday is proposed — tbii time ambler i'liuit house last thursday morning judge h k weand of the montgomery county court handed down a decision dismiss ing the injunction suits of the manor real estate company the north penn railroad company and letitia k kent against the philadelphia & lehigh val ley traction company the cases weie argued before judges swartz and weand by lawyers larze lere wright and acuff for the trolley company on oct 24 and the kent case came up on oct 28 since which time the judges have been considering the points involved in tho kent case which involved the tight of way past a property at friends corner the court merely refus es the preliminary injunction referring to the fact that the traction company has the consent of the property owners on the opposite side of the pike and the court refeis in its opinion to the case of the north penn railroad com pany which is given below for its rea son in the ease in the opinion relative to the manor real estate company owning the former wentz property opposite fort side inn and the former comly property in whiteniurali township the court holds that from the rinding of fact ' we con clude as a matter of law that the de tendants are lawfully engaged in the construction of tbe road that plaintiffs have no standing to object as no part of their property is taken or encroached upon that their ownership of the fee extends to the middle of the turnpike and defendants have the consent of the owners of land on the opposite xide^of the road and also of the township au thorities of the turnpike company which gives them the rights claimed;1 that plaintiff's bills be dismissed with costs ' ' the north penn railroad company sought to restrain the trolley company from building their street passenger railway in front of plaintiff's land which abuts the turnpike road and from crossing the highway bridge at fort washington where plaintiffs rail road intersects said highway the opinion is from the above finding of facts we conclude ac a matter of law tiial ylaiutiiis iia\t on standing taob juct it nu paiv of their i pvfrpsrry is taken 01 encroached upon their owner ship of the fee extends only to the mid dle of the turnpike road and defendants have the consent of the owners of the land on the opposite side and also or the township authorities and of the turnpike company which gives them the rights claimed " in the opinion tbe court also holds that the bridge crossing the railway at fort washington is a part of the turn pike and can be used by the defendant company subject to their making it a safe passageway in rendering the opinion judge weand gives legal sanction to common sense and common usage as follows electric passenger railways in the country have become a public necessity they have increased the value of pro perty built up villages and towns afforded conveniences otherwise not ob tainable and are a benefit especially o those whose means do not admit of other methods of travel the law should therefore be liberally construed in their favor without infringing upon the rights of others where captions technical and other objections are made for reasons not based upon equit able or strictly legal principles a court should not restrain what appears to bu a great public improvement what injury can be done to plaintiff's pro perty which is owned for railroad pur poses it is difficult to see but these are matters to be decided hereafter ' ' the precedents cited in the opinions are judge yerkes decision in the new town and bristol case and the supreme court decision in 4he lukens valley case whether an appeal to the supreme court will be made by the manor real estate company and the north penn railroad company is not known but they have 20 days frpm the rendering of the opinion in which to avail them selves of this privilege it is probable however that the case relative to the fort washington bridge crossing will be carried no further and in fact there is a well defined rumor at present that the trolley company and the railroad have already taken steps to compromise on the bridge question it is said the railroad desires the abutments of the bridge changed that in case of the laying of a four-track line they will ho sufficient to accommodate them this would involve considerable expense to the trolley company necessitating a span of about go feet and the construc tion of heavy abutment walls the bridge at present was built and is maintained l>y tho railroad ami it is likely that if an agreement relative to the batne is effected it will be along these lines on thursday south main street ex pires on jan 1 it having been renewed it the july meeting of ambler council or six months as the ordinance readh the road shall be completed and be in full operation it will be necessary to iass another ordinance at the january neeting to prtserve to the traction com pany the rights originally granted them it is very probable an extension of time will he allowed without any frictions and it is also very probable that the company will have its cars running and hie line will be in full operation before it expires lanmlule frank ilines and romanus killman lansdare youths election of two well known ambler business men as about one half the capital stock is held in ambler and as the plant of the company is located here thin plan will probably be favor ably acted upon at the meeting on jan 16 * the plant was moved from philadel phia to ambler four years ago and a works erected on south main street and the railrpad and since that time it has been running regularly and earning a 0 per cent annual dividend on its caiptal stock which to start with was less than 25,000 last year having about 10,000 in preferred stock in the treas ury of the company it was decided to dispose of this in order to muke some changes at the works one of which was the installation of a foundry after this action was decided upon the change in the steel market brought about by the organization of the steel trust operated to render the move lees advan tageoos to the fettit company than be fore and while there was a spirited de mand for the new issue of stock the original plans llnllllll.vi illltll « ll'uv er'n ufe in xorrlstown passing of n ^ treat man norristown pa dec 23 1901 we hear much of a troublesome sur plus in the treasury at washington amounting now to 40,000,000 for the current fiscal year and it is anticipated that it will reach 100,000,000 by the 1st of july next and by the end of harvest to over 200,000,000 and what shall be done with it why only n week or two ago we were informed from washington that the administration had anticipated the interest due the first of january next on the public debt by paying it now it amounting to nearly $•">, 000,000 if 5,000,000 he the interest what must the principal be a school boy could calculate and ascertain the principal debt if he were given the rate percent which can not be exactly and truly as certained by any system of ratiocination because there are different loans am the rate per cent of interest varies on each but the fact that the government has this enormous debt on the one side and a surplus of revenue on the other renders the solution easy as to low to dispose of the surplus take it and pay off that much debt that is an easy one so long as the money is on hand pome enterprising congressman or cab inet officer or adventurer may soon dis cover a scheme for its disbursement on some new adventure perhaps for the survey of another route from the gulf of mexico to the pacific coast that would about take the forty and the in crease vill soon take wings and fly away the isthmian canal will never be celebrated in song as the raging canal of the schuvlkill was in olden times but it will rather be known as the canal that needs assistance the ca nal to be that meets resistence and ever is to be but never will be built in — our day our doubts are traitors and make us lose the good we oft might win bv fearing to attempt " our peo ple bliould have taken the tehnantepec survey across the southern line of mex ico and then it would have been an american highway across the territory of a sieter republic adjacent to our own and would have saved travelers and merchants 100 miles on the way to the golden gate fooling down in darieu and ranama after spending millions ex ploring on the upper and shorter route hows lack of wisdom sincerity and nces and to listen to invited sneakers ii in respectful performance of these lutier was pathetic and elicited kindly emotions from his many friends and leigiibnrs for his devotion to the sacred little temple on the perkiomen hills in bis dailv walk he was exemplary simple and gentle in his manner and kindness was an essential element of bin nature he attended to his own horse drove around quietly among the merchants to see if they wanted more hour from cleavers mill sold and col lected for the hoys and went about his business without ostentation obtru sion or offenoe we were all sorry to lose this good citizen but the friends are especially afflicted by his demise for theirs is'a special as well as an irrepar able loss the intellectual decay and mental in capacity of j warren sunflerlaml ll i of collegeville in his old days is a sad and sorrowful realization of how a great man may fade and fall awav from all usefulness while vet in full life he is very aged he was princi pal professor at freeland seminary when i first met him as my preceptor among my colleagues at that time were miiuiv who are now no more but among the survivors are wayne mcvaugh and other lawyers and business men mr sunderutnd afterwards became the found er of the pennsylvania female college at freeland now called collegeville from which he retired after a long and successful career having educated and graduated many women bud he unfor tunately engaged in a private banking business which wrecked his fortune and he is now suffering not only from de mentia but hopeless impecuniosity the court will hear all parties interested on jan i prox as to what shall be done in the wav of appointment of a iruar dian of his person and estate when pjxburgess clamer several yeais ago bought mr runderland's real estate he voluntarily gave him his residence for a home during his life this was a generous act which all of mr suti derland's neighbors appreciate and ap piaud sundcrland was a profound nicaragua is aside from complica tions climate and its latitude the betit of the three from the carribbean sea.but we want a canal from the gulf of mex ico across mexico and directly to the pacific in the proper meiiclian of the united states all other routes inure to the benefit of foreigners more than to us i suppose it will take the au thorities another century to see it but it is true just as the reading railway company sees that its primal projec tors made a great mistake in not locat ing the road ori town instead o iginally through norris f bridgeport that mis take will cost the present company mil lions of dollars to build a biidge which they now project obliquely from their road across tiie schuylkill to the other side of the river so as to tap the old road beyond the barbadoes island let any congressman take the map and he will bee that the tehuantepec runs di rectlv across mexico from the gulf while the nicaragua route ¦ is way down the caribbean sea if the latter should ever be adopted it would not be 10 years before the people would clam or for the former just as they now urge a canal anywhere to avoid sailing clear ground south american north of the nicaragua route is nicaragua san sal vador honduras guatemala and the gulf of mexico before you reach the mouth of the mississippi another holiday is proposed — tbii time it is the birthday of wiliam mc kinley and william h smith is the author of the bill introduced in con gress on the 17th inst j hope conarees will be able to fix the day of mckin ley's birth before they pass the bill as the historians have not been able to do so four different dates have been as signed to that important epoch but as we have no holidays of any account just now why not make each ambler i'liuit house last thursday morning judge h k weand of the montgomery county court handed down a decision dismiss ing the injunction suits of the manor real estate company the north penn railroad company and letitia k kent against the philadelphia & lehigh val ley traction company the cases weie argued before judges swartz and weand by lawyers larze lere wright and acuff for the trolley company on oct 24 and the kent case came up on oct 28 since which time the judges have been considering the points involved in tho kent case which involved the tight of way past a property at friends corner the court merely refus es the preliminary injunction referring to the fact that the traction company has the consent of the property owners on the opposite side of the pike and the court refeis in its opinion to the case of the north penn railroad com pany which is given below for its rea son in the ease in the opinion relative to the manor real estate company owning the former wentz property opposite fort side inn and the former comly property in whiteniurali township the court holds that from the rinding of fact ' we con clude as a matter of law that the de tendants are lawfully engaged in the construction of tbe road that plaintiffs have no standing to object as no part of their property is taken or encroached upon that their ownership of the fee extends to the middle of the turnpike and defendants have the consent of the owners of land on the opposite xide^of the road and also of the township au thorities of the turnpike company which gives them the rights claimed;1 that plaintiff's bills be dismissed with costs ' ' the north penn railroad company sought to restrain the trolley company from building their street passenger railway in front of plaintiff's land which abuts the turnpike road and from crossing the highway bridge at fort washington where plaintiffs rail road intersects said highway the opinion is from the above finding of facts we conclude ac a matter of law tiial ylaiutiiis iia\t on standing taob juct it nu paiv of their i pvfrpsrry is taken 01 encroached upon their owner ship of the fee extends only to the mid dle of the turnpike road and defendants have the consent of the owners of the land on the opposite side and also or the township authorities and of the turnpike company which gives them the rights claimed " in the opinion tbe court also holds that the bridge crossing the railway at fort washington is a part of the turn pike and can be used by the defendant company subject to their making it a safe passageway in rendering the opinion judge weand gives legal sanction to common sense and common usage as follows electric passenger railways in the country have become a public necessity they have increased the value of pro perty built up villages and towns afforded conveniences otherwise not ob tainable and are a benefit especially o those whose means do not admit of other methods of travel the law should therefore be liberally construed in their favor without infringing upon the rights of others where captions technical and other objections are made for reasons not based upon equit able or strictly legal principles a court should not restrain what appears to bu a great public improvement what injury can be done to plaintiff's pro perty which is owned for railroad pur poses it is difficult to see but these are matters to be decided hereafter ' ' the precedents cited in the opinions are judge yerkes decision in the new town and bristol case and the supreme court decision in 4he lukens valley case whether an appeal to the supreme court will be made by the manor real estate company and the north penn railroad company is not known but they have 20 days frpm the rendering of the opinion in which to avail them selves of this privilege it is probable however that the case relative to the fort washington bridge crossing will be carried no further and in fact there is a well defined rumor at present that the trolley company and the railroad have already taken steps to compromise on the bridge question it is said the railroad desires the abutments of the bridge changed that in case of the laying of a four-track line they will ho sufficient to accommodate them this would involve considerable expense to the trolley company necessitating a span of about go feet and the construc tion of heavy abutment walls the bridge at present was built and is maintained l>y tho railroad ami it is likely that if an agreement relative to the batne is effected it will be along these lines on thursday the engineers for c h kd wards & company of allnntown contractors for the temporary power house lo be locati'd on tho heck old will property along uuthlehoui pike mar ambler were at work running lines and driving stakes several of tho tine old trees were cut down and removed the cost of the operation including the frame structure brick foundation and concrete beds for the engines and boil ers will and al nomt in tbe centre of this last section of he road to be completed from allen own to the philadelphia line the ordinance granting the company he franchise in ambler frotn rose vat ey and down south main street ex pires on jan 1 it having been renewed it the july meeting of ambler council or six months as the ordinance readh the road shall be completed and be in full operation it will be necessary to iass another ordinance at the january neeting to prtserve to the traction com pany the rights originally granted them it is very probable an extension of time will he allowed without any frictions and it is also very probable that the company will have its cars running and hie line will be in full operation before it expires lanmlule frank ilines and romanus killman lansdare youths who have been soldiers in the philippines are expected here the present week to spend some time with their parents the abram cox stove company has been incorporated with a capital of 150,000 titus president ; david tt it vice president a e keinper secretary and treasurer frank ridley and john s buchanan there is a proposition being favorably received to increase the membership to seven by the election of two well known ambler business men as about one half the capital stock is held in ambler and as the plant of the company is located here thin plan will probably be favor ably acted upon at the meeting on jan 16 * the plant was moved from philadel phia to ambler four years ago and a works erected on south main street and the railrpad and since that time it has been running regularly and earning a 0 per cent annual dividend on its caiptal stock which to start with was less than 25,000 last year having about 10,000 in preferred stock in the treas ury of the company it was decided to dispose of this in order to muke some changes at the works one of which was the installation of a foundry after this action was decided upon the change in the steel market brought about by the
