but that finletter was alone to blame for delay foi filing a poli tical opinion reflecting on the defend ant and although he did not sustain the demurrer but dismissed it he permitted the defendants to enter pleas and put the case down for trial as if there had hcen no demurrer this was fmletter's fault — he should bave sen fenced the defendant and then the case at this time would have been in the supreme court and far on the way to a finality j spent friday the kith in taking testimony in glitmlioro new jersey in a divorce case there are iii.iiiv curious differences between our system of juris prudence in pennsylvania and the course of procedure in new lers»v their equity system is much more ex tensive and coiii|u-eliensive jurisdiction ill equity extends over a variety of sub jects over there which are not the sub jects if equity jurisdiction in our slate they have chancellors vice chancellors and masters in chancery all over thw slate pennsylvania in tenacious of her old knglish common law courts and old forms of pleading and equity with us is confined to such eases only as for the correction of that wherein the law by wrtpon of universality is deficient our constitution is very liberal how ever article v section 20 of hie constitu tion of h gives to the court of com mon pleas such chancery powers as nre now vested by law in the several courts of common pica or as may hereafter be conferred upon them by law so that the legislature may wisely extend she equity or chancery lowers of the fi-oiirls there arc many case of it'll lid > accident or mistake that could he more speedily remedied corrected or repair ed by a more pliable and speedy remedy than that now in use we have no sep mate jurisdiction in chancery as they have in now jersey the powers of equity jurisdiction arc simply conferred on ihe common pleas judge just as tin powers nl ihe orphans court are committed to tin same judge in our coujlty although we have the righl lo a sepurutu orphan court hisl as they have in philadelphia and berks county ( da-.-hor i appeared to me to have onlv one element in 1*0111111011 with nm equally cold we have few houses built of wooden hoards ;
