township from which such territory is taken shall have the right to appeal from the ordinance of the town council annexing such ter ritory to the court of quarter sessions of said county the next new act approved april 28 189u is prophylacticaf and perhaps pro fitable ns it is stated in the caption to prevent the spread of contagious diseases known as yellows black knot peach rosette and pear blight among orchard and nursery trees or the fruit thereof also the infection known as the sun jose scale it is made unlaw ful to keep any tree or vine or shrub or plant tlnih affected or infested or property to establish a sys tem of sewers and drainage require connections and to provide for the cost of construction and maintenance of the same by an equitable assessment on pro pei ties benelitcd by ordinance for wuich assessments liens may be tiled in court to enter into contracts for the carrying oil of sewage from the limits of the town ship 1 o make regulations for pigpens slaughter houses subject it hus been ascertained that there are 66 houses on the heights east of the township line mad in upper dublin with an approxi mate population of l'.ml people and l'o houses on tlie west side townships of the commonwealth which are in a large measure devoted to residential purposes there is need of a form of municipal government having greater powers than are now possessed hy the local govern ments of townships under existing laws tlie conditions necessary to create a township of the first class shall be pt having a population of 300 people residing within one square mile the act abolishes tlie oiliee of road supervis ors and creates the office of township commissioners who shall be invested with all the corporate power authority and franchise of the townships ami hall have power to open grade con struct and pave all public highways to construct footways along said highways and to establish lights thereon ami to cause the sidewalks to he paved and curbed at the expense of the abutting property owners ami to establish and maintain a night watch and police force etc in fact it gives township commissioners the same power and aulhoritiy that is now given to boroigh council and practically gives tn each village of 300 inhabitants 11 the rights and privileges enjoyed by a small l»or mgh the point at issue in this case is has upper publin ihe required number of people living in the prescribed limit to make it a township of the lirst class if it has then all thai is desired hy a change from village to borough may be obtained from the election of a bourd of township commissioners who will meet the progressive spirit of the day com paratively few know anything of act no sli which provides for the classi fication of townships and which will evidently largely increase taxes in town ships and place a heavy burden upon the more rural portion of lirst-class townships as those residents will be required to pay the additional increase nun le necessary section of the net of june 2 1871j which reads anil any citizen of the borough or of the territory annexed shall have the right to appeal " by adding after the word annexed these words or of the
