LEGISLATIVE RECORD. /g&S Geo. Bergner, Printer. HARR1SBFRG. JANUARY 14,18*- Vol. 1. No. 1. PRINTED BY AUTHORITY OF THE LEGISLATURE. IN THE SENATE. Friday, January 14, 1853. An extract from the Journal of the House of Representatives was laid before the Senate, stating that they had adopted the resolution providing for the publication of a Daily Record of the proceedings of the Legislature. The SPEAKER laid before the Senate the annual statement of the accounts of the Lehigh Valley Railroad Company. PETITIONS PRESENTED. Mr. FRICK presented a petition from citizens of Montgomery county, for the opening of a State road from Springhous'e to Norristown. Mr. DARLINGTON one to authorize the executors and legatees of Sarah Davis, deceased, to sell certain real estate. Mr. HENDRICKS one from citizens of Port Carbon and East Norwegian townships, Schuylkill county, for an alteration of the school laws. REPORTS Or COMMITTEES. Mr. HOGE from the committee on Pensions and Gratuities, reported a series of joint Rules adopted by the committee for their government. [For Rules see House proceedings.] The usual number of copies was ordered to be printed. Mr. DARLINGTON, from the committee on Corporatiens, reported the bill to incorporate the Centreville Perseverence Company, of Bristol township, Bucks county, for the recovery of stolen horses and detection of horse thieves. On motion of Mr. SAGER, this bill was immediately taken up, and passed its several readings. Mr. BAILY, from the committee on Roads and Bridges, reported with amendments, the bill supplementary to the act incorporating the Temperanceville and Noblestown Turnpike and Plank Road company. [On motion of Mr. DARSIE, this bill was Subsequently taken up and passed its several leadings.] Mr. FORSYTH, from the Select committee on the subject, reported the bill to vacate East street, in the city of Philadelphia. Mr. O'NEILL moved that the bJHbe immediately taken up, which was agreed to, and the bill passed its several readings. Mr. SANDERSON, from the Select committee appointed for the purpose of arranging the several subjects embraced in the Governor's Message, made report, assigning the various matters to appropriate committees. [The Speaker informed the Senate that the committees would be announced to-morrow morning. ] Mr. BAILY, from the committee on Roads and Bridges, reported without amendment, the bill to incorporate the Newton Square and Pa- 6Ii Plank Road company. On motion of Mr. EVANS, this bill was subsequently taken up, and passed finally. RESOLUTION OF INQUIRY. On motion of Mr. DARSIE, the Stnate resumed the consideration of his resolution submitted on Tuesday last, calling on the Canal Commissioners for certain information, as follows: Attolved, That the Canal Commissioners be requested to communicate to the Senate, as soon as practicable, a detailed statement, setting ■firth to* several bids receded from contractors and others, during the past year, for the various kinds of work on the new lines for the avoidance of the inclined planes €rn the Portage rail road, specifying particularly the names of the bidders, the prices bid, and the parties to whom, and the prices at which, the same was allotted. To which Mr. QUIGGLE, on Wednesday, moved to add the following : "And that the said Canal Commissioners be also requested to obtain and communicate to the Senate, with the information above required, the prices paid for work on the Pennsylvania railroad, running parallel with the said Portage railroad, and also the prices at which any public work was allotted on the said Portage road, which was abandoned and not prosecuted to completion on account of the low prices of the same ; and also any explanations or statements the said Canal Commissioners may have to make in reference to the bids for work, and the allotments made en the said Portage road." And Mr. DARSIE, on Thursday, moved to substitute for the amendment, the following: "Also copies of the original estimates of the Engineer, exhibiting the kind3 and quantities of work on each section of said line.'" The amendment of Mr. DARSIE being now pending, the discussion was renewed, and Mr. SANDERSON having the floor, addressed the Senate in opposition to Mr. Darsie's amendment, and in favor of the ameiSdnient of Mr. QUIGGLE. The debate was further continued by Messrs. BUCKALEW and FORSYTH on the same side; and Messrs. DARSIE and KUNKEL in favor of the pending amendment, when the vote was taken and the amendment Was adopted, as follows: YEAS—Messrs. Barnes, Carothers, Crabb, Darlington, Darsie, Evans, Frick, Hamilton, Hendricks, Kinzer, Kunkel, Myers, M'Murtrie, O'Neill, Robertson, Skinner, Slifcr, Carson, Speaker.—18. NAYS—Messrs. Baily, Buckalew, Forsyth, Fry, Goodwin, Haldeman, Byron D. Hamlin, Ephraim W. Hamlin, Hiester, Hoge, M'Caslin, M'Farland, Quiggle, Sager, Sanderson.—15. f So the amendment of Mr. DARSIE waff adopted. Mr. BUCKALEW now moved the following as a further amendment: "And any explanations or statement the said Canal Commissioners may have to make in reference to the bids and allotments made en said Portage Railroad." This amendment was briefly opposed by Mr. DARSIE and advocated by Messrs BUCKALEW and FORSYTH; when it was lost by the following vote: YEAS—Messrs. Baily, Buckalew, Forsyth, Fry, Goodwin, Haldeman, Hamilton, Byron D. Hamlin, Ephraim W. Hamlin, Hiester, Hoge, M'Caslin, M'Farland, Qniggle, Saeger, Sanderson.—16. NAYS—Messrs. Barnes, Carothers, Crabb, Darlington, Darsie, Evans, Frick, Hendricks, Kinzer, Kunkel, Myers* M'Murtrie, O'Neill, Robertson, Skinner, Slifer, Carson, Speaker— 17. The resolution as amended by the amendment of Mr. DAftSIE, then passed finally. On motion of Mr. SANDERSON, the ainend- erection of frame buildings in the borough of Towanda, were considered and agreed to. So the bill goes to the Governor for his signature. [The amendment strikes out the borough of AUentown which had been inserted in the Senate.] House amendments to the bill to incorporate the Little Saw Mill Run Railroad Company, were also adopted. [The amendment is a new section, authorizing the Birmingham and Eliza- bethtown Turnpike Road Company to borrow money to complete their road.] On motion of Mr. HOGE, the Committee on Inland Navigation was discharged from the consideration of that part of the Governor's message relating to the Franklin Railroad company, amd it was transferred to the Committee on Railroads and Canals. Mr. QUIGGLE, moved that the Committee on the Judiciary be discharged from the consideration of the bill relative to allowing persons owniag Slaves to pass with them through Pennsylvania, and ffrat it be referred to a select committee. Agreed to. Mr. DARSIE reported the supplement to the act incorporating the Temperanceville and No- blest'o^n Plapk Road and Turnpike Road Company. SILLS READ' IS PLA.-K. Mr. FRICK read in place a bill for a certain State road in Montgomery county. Mr. BUCKALEW, one" relative to the State Librarian, which on his motion was referred to a select committee. Also, a bill to incorporate the Delaware, Lehigh and Wyoming Valley Railroad Company. Mr. DARLINGTON one to authorize the Executor ofSarah Davis, dee'd., to sell certain real estate. Mr. HEXDRICKS one to authorize the bo- rotfgfi of Tamaqua,Schuylkill county, to borrow mjney to erect water works, which on his motion, was taken up and passed its several readings. On motion of Mr. FORSYTH, 2,000 copies in English, and 500 in German, of the Canal Commissioners' Rep. was ordered to be printed. ELECTION OP TRANSCRIBING CLERK. On motion of Mr. ROBERTSON, the Senate proceeded to the election of a fourth Transcribing Clerk. Mr. SLIFER nominated W. W. TAYLOR, Mr. FRY, " NELSON WE1SER. Mr. TAYL0S Was elected on the first vote, the Senators voting as follows: Messrs. Barnes, Carothers, Crabb, Darlington, Darsie, Evans, Frick Goodwin, Hamilton, Hendricks, Kinzer, Kunkel, Myei"s, M'Mmrtrie, O'Neill, Robertson, Skinner, Slifer, Carson, Speaker—19—voted for W. W. TAYLOR. Messrs. Baily, Buckalew, Forsyth, Fry, Haldeman, Byron D. Hamlin, Heister, Hoge, M'Caslin, M'Farland, Quiggle, Sager—12 voted for NELSON WEISER.
