Thai ifheji a ncw district shall here¬ after be formed, such district aball not be cop sidered and recognized aa a separate and inde¬ pendent school disirict until after the termina- - Iion of the current school year in which it bo- came a new district, and nntil it have a full board of directors regularly elected or appointed and organized, except that the directors thereof shall have authority to levy, assess and collect tax, procure school houses, and do all other acts necessary to the commencement of the schools for lhe ensuing year. ... Sec. 4.V That il any balance of school funds shall remain on hand, or bo due to the disirict out ol which any new disirici shall ba formed, such balance shall, afler all just claims against the old disirict have been settled, bo dislrlbiiled between the old and new districts io proportion to the asecesable valuo of property within thair respective limits, and such new district may re cover the amount thus due by suit against the old district or districts from which it was erect¬ ed. // School Directors and Controllers. Sec 5. That school direciors shall be elecied annually in ench disirict of tbo Slate in tbe lol¬ lowing manner, lo wit: Al the same lime and place thai eleciions are held for supervisors and oonstables, and in wards in ciiies or boroughdat tbe lime and place of the borougb or ward elec¬ tions, and in liko manner. Two qualified citi¬ zens sball bc elecied school directors in each district, whose term ol office shall be three years: bui in districts where directora have not beeu elecied, or in new districts which may be established by lhe ereciion of a new ward, bor¬ ough or townahip, six direciors shall bo elected in such districts st lhe Hrst election, two to serve ono year, two to serve two years, ond two to servo threo years; and two aonually thereafter ; and in cuy and borough disiricls allowed to elect Ihree directors, the wholo number for eoch ward, shall bo chosen at the flrst annual election afierthe passage of ihis act. one lo servo for one year, one to serve for two years, one to serve for three yeare, and one annually ihereater. Sec. 6. Il the legality ol any election for directors be con¬ tested in wriling by not less than ten qualified citizens of the dialncl, the said court of -quarter sessions is beroby auihorized ond required forth¬ with to examine into tho election and to confirm or set it aside as shall seem just and proper; and if set aside to order a new eleciion at the usual place and in the usual manner, on not leas than two weeks public notice by the proper officer. Sec. 7. That each board ol directors shall have power to fill any vacancy which may occur therein by death, resignation, removal from" the disirict, or otherwise, unlil the next annnai olec¬ tion for directors, when such vacncy shall be filled by eleciing a person to supply the same. Sec. 8. That if any person duly elected a school direcior shall reluse lo atlend a regular meeling of the board afier having received written noiice from tbo secretory to appear nnd enter upon lhe duiies of his office, or if any person having taken upon him the duiies of his ofiice 03 director shall neglect to ottcnd any two regular meetings of the board in succession, un lees detained by sickness, or prevented by ab- aence from lho disirici, or to oct in his oiEcial -capacity wben inatrendarlce, the directors pres. ent shall have power to declare his aont in lhe board vacant and to appoint anoiher in his Blead; 10 serve until the next regular election. Sec. 9. That ifall the members of any board, oi direciors or coairollera ehnll refase or neglect to perlorm their duties, by.levying tho tax re. quired by law and lo put or'keep lhe school in operation so far as the means of the district will admit, or shall neglect or refuse lo perform ony other duty enjoined by law, the court of quarter sessiona of the proper county may-, upon com¬ plaint in writiug by any eix taxable citizens of the disirict, and on due proof ihereof, declare their seats vacant and appoint oihers in their •lead until the next annual election for directors. Sec. 10. That all School directora shall be ex- empied irom serFing in any township, city or borough office, and from the performance ol militia duly. Sec. II. That school directors elecied under the provisions of former acts, except in indepen- dent districts abolished hy this act, shall sever¬ ally hold their offices during the term for which they were elected; andall oppropriations au¬ thorized by former acts, wh»ther by tho State or county, ond all taxes authorized to be raisod for school purposes, shall be collected as they would have been collected if this act hadnot beon passed. 111. OJkers and Meetings ofthe Board. Sec. 12. That annually, and within twenty daye after the election of directors, each board of school directors (ond each boardof controllers in cities and boroughs' shall meet ontl organize by choosing a president and secreraryi who shall bo members ot tho board, and a trensuMr who may be a member of the board or otherwise at the discretion oftho directors or controlleta. Sec. 13. That tho president shall preside nt the raeciings ol tbe board, call special mBelinjis when necessary, issue the duplicate and warrant for the collection of the district taxea, lake suf¬ ficient bond Irom tho district treasurer for the faithful discharge ol his duty, sign the cellificate oi the assessment of ihe disirict taxes, and all orders ireued on ihe diairict ireasurer by ordor oflhe board; also the annual report ofthe dis¬ trict to the county saperintendent, and generally to do and perlorm all other acts and duties law¬ fully pertaining lo the offico of president of the board. Sec. H. That the secretary shall keep full mmmes ofall the proceedings oftho board in a book provided lor ibat purpose, prepare tho duplicate 01 Bohool tax, keep an accouni of all abatements nnd exonerations mado by ihe board prepare, attest and forward to the couniy super, mteodont the annual certificate that the schools have been kept openduringthe minimum period specified by law, also the annual report of the diatrict, prepare and attest all. orders on the treastlf er, aud do and perform all other acts and duties lawfully pertaining to the offico of secre¬ tary ofthe board, and forhis sorvicea shall ro- appoinimeni to fill vacancies in the hoard, as is hereinbefore direcied. . Sec 19. That all deads and other conlracls in writing made by a school district, shall bo signed and sealed by the president ol lhe board of di¬ rectors or controllers and countersigned by the secretary. Sec. 20. Thai all suits by a schoqr distriot shall ba. brought in us corpoitite namo and bo conducted and.roanaged by the board of direc¬ tors or controllers as the case- rosy be;-and all suits against such districts shall style tbo same by ita corporate name, and all legal process other than write to enforce payment of a judgment, shall be served on either the president or sec¬ reiary of lhe board of direciors or controllers as the rase may he. Sec. 21. "i'hat if judgments shall be oblained against a achool district in nny aciion orfpro- ceeding, the patty eniiiled to tbe benefit ofsuch judgment may have execution ihereof, as fol lows, and not otherwise, to wit: It sball bo law¬ ful for the court in whicb such judgment shall bo obtained, or to which sach judgment shall be removed by -transcript from u jusiice of the peoco or alderman, lo issue thereon a writ com¬ manding the directors or controllers and treasu¬ rer of such school disirict lo cause the amount, thereoi, with interest and costs, to be paid lo the party entitled to tho benefit of such judg¬ ment out of any monies unappropriated ol such disirict, or ifthere be no snch monies out of the first monies that shall be received for the uso ol such disirict and to enforco obedience to such wril by attachment. r. Seal Estaie for School Houses. Sec. 22. That for the purpose ot erecting shool houses, or purchasing ground whereon lo erect school bouses, it shall bo lawful for lhe directors or controllers ofany district lo borrow money at a ralo ol intereat not exceeding six per cent, and iasue bonds therefor in suras of not less than ono hundred dollars each. Frotided, That the total indebtedoesa incurred by any dis¬ trict under tho provisiona of this'act shall not at any time exceed one half of one per centum of lhe assessed value of the real esiate ofsuch dis- ri. General Powers and Ditties if the Dir'ectors. Sec. 23. That lhe board of direciors ol overy disirict (and controllers in cities and boroughs under the proviaions of seeiion second) shall pos¬ sess and exercise the following powers and porform the following duiies, logeiher wilh the oihcr powers and duties given and enjoined by this act: I. They shall establish a suiScient number of common schools for the educalion of every iiidi- vidual above ihe oge of five and under twenty- one yeara in their respective districts who may apply for odmiasion and instruction either in per¬ son or by parent guardian or next friend. II. They shall cause suitable lots ol ground lo be procured and suitable buildings to be erected, purchased or rented for scbool houses, and shall supply the same with the proper convenience and fuel, and shall havo power with the directors and controUera of adjoining disiricls lo eatablish joint schools, and the expenses shall he paid as moy be agreed upon by the directors or control¬ lers ofsaid disiricls. III. In all coses where real estate bas been or is held- by trustee* for the c«osml oso of- the neighborhood as a school houso or its appenda¬ ges, and the same has been or shall be conveyed to the achool disirici by Burviving trustee, such conveyance shall he as valid to pass the legal estate in the premises to such school as if exe cuted by all ofthem pursuant to tho fourteenth section of the act of thirteenth Juno, Anno Domini one ihousand eight hundred and thirty- six. IV. They shall exerciso a general supervision over lhe scnools ol their respective districts, and bhall by one or moroof their number, viait every school in the district at least once in each month and shall cause the result ofsuch visit to bc en¬ tered on the minutes-of the board. V. They ahall have the appointment of all the teachers of common schools in the disirict, fix the amount ot teachers' salaries, and may dis¬ miss them at any limo for incompetency, cruel¬ ty, negligence or immorality. VI. They shall direct what branches of learn¬ ing shall be taught in each school and what books shall be used agreeably to the provisions of this act, and may suspend or expel from the scbool all pupils found guilty, on lull - examinu- tion and bearing, of refractory or incorrigibly bad conduci. VII. They shall pay all necessary expenses ol the schoola by drafts on the disirict Ireasurer, aigned by the presidenl and attested by lhe secretary of the board, the samo being entered on the minuies. VIII. Each board of direciors and controllers, shall annually on or before the first Monday in June make a report to the county superintend¬ ent, setting forth tho number und sitnotion of the schools in thoir district, the character of the teachers, dcBignating wHether male or femalo, the number and sex of tho scholars admitted during the year, the number of months in the year during which the school shall havo bebn open, the amount ofschool lax levied and col¬ lecled, the cost of school houses either for build¬ ing, renting or repairing, and all other expenses which may bave been incurred in maintaining the schools oftheir districts, together with auch other information as may be beneficial in form¬ ing a just estimate of tbe operation of the school syttem. IX. That the directors (and conlr^llera of tbo respective districts shall have power to establish schools of difierent grades and to delermiho into which school each pupil shall be admitted; and if it shall be foimd that on account of great dis¬ lauce from, or difBculty of access to, the proper school house in nny diBtrict, somo of the pupila thereof could be more conveniently accommo¬ dated in. tho achools of an adjoining district, it shnll he the duty of tho directors or controllers of such adjoining district lo mnke an arrange¬ ment by which such pupils may be insirucied iu lho most convenient school of tho odjoining diairict, and ths exponso of such instruction shall be paid as may be agreed upon'by the di¬ rectors or controllers ofsuch odjoining districts by resolution or agreement entered upon the minuies of the respective boards. Sac. 24. That lbe directors or controllers of tbo aeveral districts ot tho State aro bereby "au- thorized add reijuired to establish wiihin their reapective districts separate schools for the tui¬ lion of negro and mulatto children, whenever auch schools can bo so located as to accommo¬ dale twenty er more pupils; and whenever such separate schoola shall be eslablisbed and kepi open four moniha in any year, the directors or controllers shall not be compelled to admit such pupils inio nny other schools of tho districi. Skc 25. That immediately after the annaal election of teachers in each scbool district of tho State, and before the oponing of tho schools for the ensuing term, there shall be a meeting ol the directors or controllers and teachers of eacb disirict. at which meeting the direciors and con- irbllers shall select snd decido upon a series of school books in the difierent brsnches to be taught during tho ensuing year: whicb books, and no others, shall be used In the schools of the district during said period. Sec. 26. That it'shall not be lawful for the county superintendems, direciors or controllers, or any other- persons officially connecied .wtih tho common school system, to becomo agenis for the aale, or in any way to promoto the sale, of aoy school books, maps, charts, school ap. paratus, or stationary, or lo receive compensa ceive such compensation as tbe board may direct. Sec. 15. Sec 32. That no peraon.-shall be appointed collector of the school tax unlos he shall give bond in sucb amount as shall bo deiermined bv tbe boardof direcloraor controUers, and with auoh surety or surities therein as shall be satis- iactory to the directors or controllers, or a bond wilh mortgage of real estaie sufficient to secure such amount. Sec 33. That the board of directors tor con¬ troUera in cities or boroughs where the achool property is vested in them agreeably to the pro¬ visions of section second) may nt anytime, not oftener than onco in each achool year, levy a special tax not exceeding the amount ofthe reg¬ ular annual lax for such year, lo ba applied sole¬ ly to the purpose of purchasing or paying for tbe bound and the building or erection of scbool buildings thereon, which said tax shall be levied and collected al the same time in the same manner and with like nuthority as the reg- Sec. 34. That whenever school lax asseF-sed on unseated lands in any district shall notbe voluntarily paid by tbe owner or owners there¬ of, Ihe collector shall certify thesame to tho proper county commisaionera who shall enforce the collection thereof with the laxes assessed on unseated lands for couuty purposes, and when so collected shall be psid tothe districi ireasuer by orders drawn on the county treasurer. Sec 35. That it shall be the duty of the sev¬ eral asaessora to assess auch persona as may re¬ move inlo tbeir respective diatricte beiween the last assessment and the first of May in each vear, or who may have been omitted from the last assessment, and to return their namea with tbe amount of Slate and county lox payable by each, to the board ofschool directors, who shall thereupon assess the amount of scbool tax payable by such peraons, which tax shallbe col¬ lected aa in other caaea. Sec. 36. That as soon as the schools of any difltrict have been kept open and in operation at least four months subsequent to ihe first Monday in June preceeding, the president of thc board of directors or controllers ahall certify ihe aame under oath or affirmation, together with the name of the diatrict treasurer and his post office addreaa, lo the county superintendent, whoshall immediately forward the samo lo the superin- , tendent. who shall immediately forward thc i eame lo the superintendent of common schools, | who upon the receipt of tho aame aball draw hia warrant on the State Treasurer for the whole amount such district is entitled io receive from the annual State appropriation. IX County Superintendents. 37. That there shall be chosen in ihe manner hereinafter direcied an ofiicer for each county, to be called the County Superincendeni. Sec 38, It shall be the duty of each County Superintendent to see that in every district there shall be taught orlhograpy, writing. Eng¬ lish grammar, geography and arithmetic, as well as such other branches as the boardof di¬ rectora or controllers may requiro. In case the boardof directors ahall fail to provide compe¬ tent teachers to teach thc several branches above specified, it shall be the duty of iho couniy au - periniendent to noiify the board of direciors or controllers in writing of their neglect; and in caae provision ie not made forthwith for teach¬ ing the branches aforesaid lo repori such fact to the Superintendent of Common Schools, whose duly it ahall be to withhold any warrant for the quota ol such districi of the annual Stale appro¬ priation until the county superintendent shall notify him ihat competent teachers of the bran¬ ches aforesaid have been employed ; and in case of neglect or refusal of the board of directors or controllers to employ such competent teachera as aforesaid for one month after such notification by thecounty superintendent that auch teachers havo not been provided* such disirict shalt forfeit absolutely its whole quota of the Si aie appropri¬ ation for that year. Sec. 39, That the achool direciors of the the aeveral counties of the Commonwealth shall meet in convention at the seat of jusiice oi the proper couniy on the first Monday of June next, and on the firsl Monday pf May 'm each third year thereafter, and select viva voce by a ma¬ jority of the wholo number of directors pres¬ ent one person of literary and scientific acquire¬ menia and of skill and experience in the art of leaching as couniy euperintendent for the three sncceeding school years, and the echool direc¬ tors or a majority of them in such convention^ shall determine the amount of compensation tor the county superintendent, which said com pensation shall be paid bythe Superintendent of Common Schools by his warrant drawn upon tho State Treasurer in half yearly instalments if desired, and shall be deducted from the amount of the State appropriation to be paid the several school districts for said county. Sec 40. That it shall be the duty of the pre¬ sident and secretary o! the triennial convention of directors to certify lo the Superintendent of Common Schools the name and post ofiice ad¬ dress of tbe person elected couniy superinten¬ dent in pursuance of the provieiona of this act, and those of all the other candidates who re¬ ceived votes, togetherwith the amountof com pensation fixed upon by aaid conveniion. Upon the receipt of auch certificate, if no valid objec¬ tion be made, the Superintendent oi Common Schools sball commission, the Superintendent of Common Schools may require such evidence under oath or afilrmatiou in regard to the election or qualifications of the person elected county superintendent as he shall deem neceasary and shall then issue his commission to the person properly qualified, wbo shall have received the highast number of votes. Sec 41. That it ahall be the duty of the County Saperintendent 10 examine all the can¬ didates for tbe profession of teacher ia the prea¬ enco of lhe board of directors or controllers, should they desire to be preeent, and lo give each peraon found qualified, a certificate setting forth lhe brancbes of learning he orshe is capa¬ ble ol teaching, and such examination and cer¬ tificate shall be employed in teaching any branch of shall be renewed as often as any such teacher leorning other Ihan thoso enumerated io his or her certificate; and no teacher shall beemploy- ed in leaching any branch of learning oihor than those enumerated in hia or her certificate: nnd Qu teacher shall be employed in any school to teach othcT brancbes than these eet torth in such certificate ot said teacher- Frovidad, That tho county euperintendent may annul any such cer¬ tificate given by him or his predeceBsor in ofiice when ho shall thiok proper, giving at least ten days previous notica thereot in writing tothe teacher holding it nnd to tho directors or con¬ trollers of tho district'in which he or she may¬ bo employed. Sec. 42, That county superintendents shall annually on or before the first Monday in J uhe forward to the Superintendent of Common Schools the reports of the several echool dia- triciB of their respective countiea and shall also themselves make an extended reportof the con- ditionof tho schools under their xbarge, sug¬ gesting each improvements in the school syetem as they may deem useful and giviog snch infor¬ mation in regard to the practical operation of common schools and the laws relating thereto ae may ba deemed oi public intereat. That no peiaon ahall herealter be in- compeient lo give evidence in any suit or action in which any school district or any ofiicer ihereof is a party for or on accouni oi said peraon being an inhabitant oi the district, or by roason of his being liable to the payment ofany tax in which paid school district may be inlerested. Thai ifheji a ncw district shall here¬ after be formed, such district aball not be cop sidered and recognized aa a separate and inde¬ pendent school disirict until after the termina- - Iion of the current school year in which it bo- came a new district, and nntil it have a full board of directors regularly elected or appointed and organized, except that the directors thereof shall have authority to levy, assess and collect tax, procure school houses, and do all other acts necessary to the commencement of the schools for lhe ensuing year. ...
Sec. 4.V That il any balance of school funds shall remain on hand, or bo due to the disirict out ol which any new disirici shall ba formed, such balance shall, afler all just claims against the old disirict have been settled, bo dislrlbiiled between the old and new districts io proportion to the asecesable valuo of property within thair respective limits, and such new district may re cover the amount thus due by suit against the old district or districts from which it was erect¬ ed.
// School Directors and Controllers. Sec 5. That school direciors shall be elecied annually in ench disirict of tbo Slate in tbe lol¬ lowing manner, lo wit: Al the same lime and place thai eleciions are held for supervisors and oonstables, and in wards in ciiies or boroughdat tbe lime and place of the borougb or ward elec¬ tions, and in liko manner. Two qualified citi¬ zens sball bc elecied school directors in each district, whose term ol office shall be three years: bui in districts where directora have not beeu elecied, or in new districts which may be established by lhe ereciion of a new ward, bor¬ ough or townahip, six direciors shall bo elected in such districts st lhe Hrst election, two to serve ono year, two to serve two years, ond two to servo threo years; and two aonually thereafter ; and in cuy and borough disiricls allowed to elect Ihree directors, the wholo number for eoch ward, shall bo chosen at the flrst annual election afierthe passage of ihis act. one lo servo for one year, one to serve for two years, one to serve for three yeare, and one annually ihereater.
Sec. 6. Thai duplicate returns of all elections for directors shall be made oul, aigned and seal¬ ed, by thc judges and delivered by tba constable or proper oIKcer ol said olection, one to the board ol direciors and ihe oiher lo the clerk of ... tie court of -quarter sessions oi" tho coumy wilh- ¦ in ten days thereafter! ond eacb person elecied a director ehall be noiified thereof in wriling wilhiii five days after Uic electiou by the consta¬ ble or other officer who hold tho election. Il the legality ol any election for directors be con¬ tested in wriling by not less than ten qualified citizens of the dialncl, the said court of -quarter sessions is beroby auihorized ond required forth¬ with to examine into tho election and to confirm or set it aside as shall seem just and proper; and if set aside to order a new eleciion at the usual place and in the usual manner, on not leas than two weeks public notice by the proper officer.
Sec. 7. That each board ol directors shall have power to fill any vacancy which may occur therein by death, resignation, removal from" the disirict, or otherwise, unlil the next annnai olec¬ tion for directors, when such vacncy shall be filled by eleciing a person to supply the same.
Sec. 8. That if any person duly elected a school direcior shall reluse lo atlend a regular meeling of the board afier having received written noiice from tbo secretory to appear nnd enter upon lhe duiies of his office, or if any person having taken upon him the duiies of his ofiice 03 director shall neglect to ottcnd any two regular meetings of the board in succession, un lees detained by sickness, or prevented by ab- aence from lho disirici, or to oct in his oiEcial -capacity wben inatrendarlce, the directors pres. ent shall have power to declare his aont in lhe board vacant and to appoint anoiher in his Blead; 10 serve until the next regular election.
Sec. 9. That ifall the members of any board, oi direciors or coairollera ehnll refase or neglect to perlorm their duties, by.levying tho tax re. quired by law and lo put or'keep lhe school in operation so far as the means of the district will admit, or shall neglect or refuse lo perform ony other duty enjoined by law, the court of quarter sessiona of the proper county may-, upon com¬ plaint in writiug by any eix taxable citizens of the disirict, and on due proof ihereof, declare their seats vacant and appoint oihers in their •lead until the next annual election for directors. Sec. 10. That all School directora shall be ex- empied irom serFing in any township, city or borough office, and from the performance ol militia duly.
Sec. II. That school directors elecied under the provisions of former acts, except in indepen- dent districts abolished hy this act, shall sever¬ ally hold their offices during the term for which they were elected; andall oppropriations au¬ thorized by former acts, wh»ther by tho State or county, ond all taxes authorized to be raisod for school purposes, shall be collected as they would have been collected if this act hadnot beon passed.
111. OJkers and Meetings ofthe Board. Sec. 12. That annually, and within twenty daye after the election of directors, each board of school directors (ond each boardof controllers in cities and boroughs' shall meet ontl organize by choosing a president and secreraryi who shall bo members ot tho board, and a trensuMr who may be a member of the board or otherwise at the discretion oftho directors or controlleta.
Sec. 13. That tho president shall preside nt the raeciings ol tbe board, call special mBelinjis when necessary, issue the duplicate and warrant for the collection of the district taxea, lake suf¬ ficient bond Irom tho district treasurer for the faithful discharge ol his duty, sign the cellificate oi the assessment of ihe disirict taxes, and all orders ireued on ihe diairict ireasurer by ordor oflhe board; also the annual report ofthe dis¬ trict to the county saperintendent, and generally to do and perlorm all other acts and duties law¬ fully pertaining lo the offico of president of the board.
Sec. H. Sec. 22. That for the purpose ot erecting shool houses, or purchasing ground whereon lo erect school bouses, it shall bo lawful for lhe directors or controllers ofany district lo borrow money at a ralo ol intereat not exceeding six per cent, and iasue bonds therefor in suras of not less than ono hundred dollars each. Frotided, That the total indebtedoesa incurred by any dis¬ trict under tho provisiona of this'act shall not at any time exceed one half of one per centum of lhe assessed value of the real esiate ofsuch dis-
ri. General Powers and Ditties if the Dir'ectors. Sec. 23. That lhe board of direciors ol overy disirict (and controllers in cities and boroughs under the proviaions of seeiion second) shall pos¬ sess and exercise the following powers and porform the following duiies, logeiher wilh the oihcr powers and duties given and enjoined by this act:
I. They shall establish a suiScient number of common schools for the educalion of every iiidi- vidual above ihe oge of five and under twenty- one yeara in their respective districts who may apply for odmiasion and instruction either in per¬ son or by parent guardian or next friend.
II. They shall cause suitable lots ol ground lo be procured and suitable buildings to be erected, purchased or rented for scbool houses, and shall supply the same with the proper convenience and fuel, and shall havo power with the directors and controUera of adjoining disiricls lo eatablish joint schools, and the expenses shall he paid as moy be agreed upon by the directors or control¬ lers ofsaid disiricls.
III. In all coses where real estate bas been or is held- by trustee* for the c«osml oso of- the neighborhood as a school houso or its appenda¬ ges, and the same has been or shall be conveyed to the achool disirici by Burviving trustee, such conveyance shall he as valid to pass the legal estate in the premises to such school as if exe cuted by all ofthem pursuant to tho fourteenth section of the act of thirteenth Juno, Anno Domini one ihousand eight hundred and thirty- six.
IV. They shall exerciso a general supervision over lhe scnools ol their respective districts, and bhall by one or moroof their number, viait every school in the district at least once in each month and shall cause the result ofsuch visit to bc en¬ tered on the minutes-of the board.
V. They ahall have the appointment of all the teachers of common schools in the disirict, fix the amount ot teachers' salaries, and may dis¬ miss them at any limo for incompetency, cruel¬ ty, negligence or immorality.
VI. They shall direct what branches of learn¬ ing shall be taught in each school and what books shall be used agreeably to the provisions of this act, and may suspend or expel from the scbool all pupils found guilty, on lull - examinu- tion and bearing, of refractory or incorrigibly bad conduci.
VII. They shall pay all necessary expenses ol the schoola by drafts on the disirict Ireasurer, aigned by the presidenl and attested by lhe secretary of the board, the samo being entered on the minuies.
VIII. Each board of direciors and controllers, shall annually on or before the first Monday in June make a report to the county superintend¬ ent, setting forth tho number und sitnotion of the schools in thoir district, the character of the teachers, dcBignating wHether male or femalo, the number and sex of tho scholars admitted during the year, the number of months in the year during which the school shall havo bebn open, the amount ofschool lax levied and col¬ lecled, the cost of school houses either for build¬ ing, renting or repairing, and all other expenses which may bave been incurred in maintaining the schools oftheir districts, together with auch other information as may be beneficial in form¬ ing a just estimate of tbe operation of the school syttem.
IX. That the directors (and conlr^llera of tbo respective districts shall have power to establish schools of difierent grades and to delermiho into which school each pupil shall be admitted; and if it shall be foimd that on account of great dis¬ lauce from, or difBculty of access to, the proper school house in nny diBtrict, somo of the pupila thereof could be more conveniently accommo¬ dated in. tho achools of an adjoining district, it shnll he the duty of tho directors or controllers of such adjoining district lo mnke an arrange¬ ment by which such pupils may be insirucied iu lho most convenient school of tho odjoining diairict, and ths exponso of such instruction shall be paid as may be agreed upon'by the di¬ rectors or controllers ofsuch odjoining districts by resolution or agreement entered upon the minuies of the respective boards.
Sac. 24. Sec 33. That the board of directors tor con¬ troUera in cities or boroughs where the achool property is vested in them agreeably to the pro¬ visions of section second) may nt anytime, not oftener than onco in each achool year, levy a special tax not exceeding the amount ofthe reg¬ ular annual lax for such year, lo ba applied sole¬ ly to the purpose of purchasing or paying for tbe bound and the building or erection of scbool buildings thereon, which said tax shall be levied and collected al the same time in the same manner and with like nuthority as the reg-
Sec. 34. That whenever school lax asseF-sed on unseated lands in any district shall notbe voluntarily paid by tbe owner or owners there¬ of, Ihe collector shall certify thesame to tho proper county commisaionera who shall enforce the collection thereof with the laxes assessed on unseated lands for couuty purposes, and when so collected shall be psid tothe districi ireasuer by orders drawn on the county treasurer.
Sec 35. That it shall be the duty of the sev¬ eral asaessora to assess auch persona as may re¬ move inlo tbeir respective diatricte beiween the last assessment and the first of May in each vear, or who may have been omitted from the last assessment, and to return their namea with tbe amount of Slate and county lox payable by each, to the board ofschool directors, who shall thereupon assess the amount of scbool tax payable by such peraons, which tax shallbe col¬ lected aa in other caaea.
Sec. 36. That as soon as the schools of any difltrict have been kept open and in operation at least four months subsequent to ihe first Monday in June preceeding, the president of thc board of directors or controllers ahall certify ihe aame under oath or affirmation, together with the name of the diatrict treasurer and his post office addreaa, lo the county superintendent, whoshall immediately forward the samo lo the superin- , tendent. who shall immediately forward thc i eame lo the superintendent of common schools, | who upon the receipt of tho aame aball draw hia warrant on the State Treasurer for the whole amount such district is entitled io receive from the annual State appropriation. IX County Superintendents. 37. That there shall be chosen in ihe manner hereinafter direcied an ofiicer for each county, to be called the County Superincendeni. Sec 38, It shall be the duty of each County Superintendent to see that in every district there shall be taught orlhograpy, writing. Eng¬ lish grammar, geography and arithmetic, as well as such other branches as the boardof di¬ rectora or controllers may requiro. In case the boardof directors ahall fail to provide compe¬ tent teachers to teach thc several branches above specified, it shall be the duty of iho couniy au - periniendent to noiify the board of direciors or controllers in writing of their neglect; and in caae provision ie not made forthwith for teach¬ ing the branches aforesaid lo repori such fact to the Superintendent of Common Schools, whose duly it ahall be to withhold any warrant for the quota ol such districi of the annual Stale appro¬ priation until the county superintendent shall notify him ihat competent teachers of the bran¬ ches aforesaid have been employed ; and in case of neglect or refusal of the board of directors or controllers to employ such competent teachera as aforesaid for one month after such notification by thecounty superintendent that auch teachers havo not been provided* such disirict shalt forfeit absolutely its whole quota of the Si aie appropri¬ ation for that year.
Sec. 39, That the achool direciors of the the aeveral counties of the Commonwealth shall meet in convention at the seat of jusiice oi the proper couniy on the first Monday of June next, and on the firsl Monday pf May 'm each third year thereafter, and select viva voce by a ma¬ jority of the wholo number of directors pres¬ ent one person of literary and scientific acquire¬ menia and of skill and experience in the art of leaching as couniy euperintendent for the three sncceeding school years, and the echool direc¬ tors or a majority of them in such convention^ shall determine the amount of compensation tor the county superintendent, which said com pensation shall be paid bythe Superintendent of Common Schools by his warrant drawn upon tho State Treasurer in half yearly instalments if desired, and shall be deducted from the amount of the State appropriation to be paid the several school districts for said county. Sec 40. That it shall be the duty of the pre¬ sident and secretary o! the triennial convention of directors to certify lo the Superintendent of Common Schools the name and post ofiice ad¬ dress of tbe person elected couniy superinten¬ dent in pursuance of the provieiona of this act, and those of all the other candidates who re¬ ceived votes, togetherwith the amountof com pensation fixed upon by aaid conveniion. Upon the receipt of auch certificate, if no valid objec¬ tion be made, the Superintendent oi Common Schools sball commission, the Superintendent of Common Schools may require such evidence under oath or afilrmatiou in regard to the election or qualifications of the person elected county superintendent as he shall deem neceasary and shall then issue his commission to the person properly qualified, wbo shall have received the highast number of votes.
Sec 41. That it ahall be the duty of the County Saperintendent 10 examine all the can¬ didates for tbe profession of teacher ia the prea¬ enco of lhe board of directors or controllers, should they desire to be preeent, and lo give each peraon found qualified, a certificate setting forth lhe brancbes of learning he orshe is capa¬ ble ol teaching, and such examination and cer¬ tificate shall be employed in teaching any branch of shall be renewed as often as any such teacher leorning other Ihan thoso enumerated io his or her certificate; and no teacher shall beemploy- ed in leaching any branch of learning oihor than those enumerated in hia or her certificate: nnd Qu teacher shall be employed in any school to teach othcT brancbes than these eet torth in such certificate ot said teacher- Frovidad, That tho county euperintendent may annul any such cer¬ tificate given by him or his predeceBsor in ofiice when ho shall thiok proper, giving at least ten days previous notica thereot in writing tothe teacher holding it nnd to tho directors or con¬ trollers of tho district'in which he or she may¬ bo employed.
Sec. 42, That county superintendents shall annually on or before the first Monday in J uhe forward to the Superintendent of Common Schools the reports of the several echool dia- triciB of their respective countiea and shall also themselves make an extended reportof the con- ditionof tho schools under their xbarge, sug¬ gesting each improvements in the school syetem as they may deem useful and giviog snch infor¬ mation in regard to the practical operation of common schools and the laws relating thereto ae may ba deemed oi public intereat.

Sec 47. That it shall be.theduty of the com¬ missioners of each county toflsceriain trienially with the assislance of the respective assessors, the exact nnmber of taxable citizens residing in each school diatnct in their several counties, and to cerlify the same under their heoda ond sealsofoffice tothe Superintendentof Common Schools, who is hereby directed to adopt ihe number of taxables thus certified to him as the- bosiB of distribution of the State appropriation ; which aaid certificate shall be prepared and trana- mttted onor before the. first Monday ol Juoe, in every ihird year, commencing with the first Monday in "June, 1854, and if the coramisBion- ers. of any county shall neglect to forward auch certificates on or before aaid day, the Superin¬ tendent may in auch caae adopt the numberof taxables aet forth ia the next preceeding certifi¬ cate or return.
Sec 48, That if any error in the certiflcates of laxables ahall occur whereby a disirict shall receive mora or less, of the State appropriation tban ia justly due said district, the county com¬ misaioners shall have authority and they aro hereby required, immediately to lorward to the supeiintendeni a correcied list .ot laxables and* lho Eupcrintendent,sball thereupon make it the basis of the appropriatioti due said district.

That tbo act and ite supplements now m operation in the ctty and couniy of Phil¬ adolphia, entitled "An act to provide for tfao education of children at the public expense wiihin tho city and county of Philadelphia," are declared lo be concurrent with the provisions of this act, and are in no wise to be considered ,qa, allered, amended or repealed, except sd far iha^* the aoid city and coumy "shall ht' dnlitled to re¬ ceive their due: proporlion and share of ihe annual Stale appropriation; nor shalt anything contained in this act bo deemed and taken to aher. or inany marinertainterlere with, thesys¬ tem of pubiic achoola now in operation intbe aaid city and county ; and thai the act entitled "An act relaling to common schools of ihe city of Lancaster," approved the second day of Jsn. 1850, and the act relative to the common schoola in the boroogh of Carlisle, approved jApril 15, 1850, ore also hereby coniinued in full force, so lhat none of the proviaiona ofthia act shall apply to the aaid city or boroueh except such as are not inconsistent wiib the provisions of thoso acts.
Sec 51. That no peiaon ahall herealter be in- compeient lo give evidence in any suit or action in which any school district or any ofiicer ihereof is a party for or on accouni oi said peraon being an inhabitant oi the district, or by roason of his being liable to the payment ofany tax in which paid school district may be inlerested. '
Sec. 52. That allformer acts and parte of acts relative to the common school system which are supplied hy, or are inconsistent wiih tho provia¬ iona of this act. antf all lawa relating toor creating independent dietricta. or authorizing the estab lishment of aub-distrieta and the appointment of committees, are hereby repealed.
Sec 53. That immediately afier tho passage oftbis act the Superintendent shall prepare and havo printed and forward six copies ofit to thc secretary of each board of directors and one copy to the commisaioners of each couniy in the State.
