This consideration did not, however, affect his spirits, and, having dyed his whiskers and primed himself with whisky, Hildebrand began to cast about to see who he could conveniently shoot, cut, or otherwise destroy. Pursuant to this amiable design, lie went one quiet afternoon into the drinking-saloon of Joseph Bishop. One of the crowd present invited all hands to drink. Three of the strongest undertook to arrest the bushwhacker, and soon found they had their hands full. He knocked men down right and left, shot mo.re than one, aud cut half a dozen. His knife was wrested from him, but he whipped out another. This, too, was torn from him after a bloody struggle. The undaunted desperado instantly drew a third. But the last act of the drama was close, at hand, and Sam. Eildebrand's career of guilt and violence was destined to be cut short. He had just struck a frightful blow at an officer named Ragland, into his thigh and making a gash from the knee to the hip. On this Ragland drew a revolver and shot his assailant through the head. ball struck just behind the right ear, aud ranged thence into the base of the brain. Hildebrand lived some minutes after, but never spoke again. Neither did he give utterance to the slightest sound, not even a murmer of pain. When the case was given to the jury those twelve vec.men retired to their room and sat down to make a verdict. After discussing the subject for a time, it was proposed to try and arrive at a verdict by "chalking." One man thought the plaintiff had been injured to the amount of $25, and so expressed it on the under side of a piece of white paper ; another estimated #5, and so on ; several getting down as low as one cent. The sums total were added up, and the amount averaged. The result was $4.42 and a fraction; but as they didn't want to appear mean, the jury concluded to repoit the sum of §4.43, and so they rendered their verdict to the court. When the case was given to the jury those twelve vec.men retired to their room and sat down to make a verdict. After discussing the subject for a time, it was proposed to try and arrive at a verdict by "chalking." One man thought the plaintiff had been injured to the amount of $25, and so expressed it on the under side of a piece of white paper ; another estimated #5, and so on ; several getting down as low as one cent.
