C S | BECAUSE • j[ - C« ti Los Angeles, Cnl., Dee. 6.—A Wellw- Fargo express ear on an Atchison, Topeka and Santa Fe overland passenger train, westbound, was entered somewhere between Needles and Daggett, arid Evan O. Roberts, express messenger, was shot and probably fatally wounded. The way safe was rifled, but the main safe, said to contain $200,000 in pension money, was not robbed, so far as known. Officers of the express company say the robber secured about $400 and that the main safe was not opened. f At this season of the lyar the demand for warm and serviceable hosiery and underwear steadily Increases. His last official duty was as assistant attorney geheral for the post office department, from which office he was removed last year became of his indictment, together .with his nephew, Harrison J. Barrett, on a charge of conspiracy in connection with the use of the mails by certain alleged getrich-qnlck concerns. On this charge he was acquitted by a jury. Conductor Hawes opened the door of the express car at Daggett and found Messenger Roberts lying on the floor semiconscious. The contents of the rifled safe were scattered about the car. Roberts was so seriously wounded that he was unable to tell much about the robbery. He said that he had discovered some one on the blind baggage shortly after the train left Needles and had been about to open the door when a man, whom he took to be a negro, broke open the door and enteved. Mr. Tyner was born in Broolivllle, Ind., Jan. 17, 1820. He had been identified with the postal service most of the time since March, 1801, when he was appointed a special agent in the postoffice department. Perjury Charged Against Baltimorians. Baltimore, Dec. 6.—Ten persons, residents of Baltimore, have been arrested on indictments by tie federal grand Jury on the charge of false swearing in connection with applications for naturalization papers. Two of them, Jacob Keiner and Charles Eisensteln, confessed their guilt and asked United States Judge Morris for mercy. The ever increasing casualty list upon our railroads is a mntter of grave public concern and urgently calls for action by the congress. The passage of a law requiring the adoption of a block signal system has been proposed to the congress. I earnestly concur in that recommendation and would also poilit out to the congress the urgent need of legislation in the Interest of the public safety limiting the hours of labot for railroad employees in train service upon railroads engaged in interstate commerce and providing that only-trained and experienced persons be employed in positions of responsibility connected with the operation of trains. The Wells-Fargo company was expecting a large shipment of United States pension money totaling $200.- 000, it is said, and it is possible that this shipment may have been on the train. It is known that the local officials were greatly exercised over the robbery and at Barstow placed a substitute messenger on board the car with orders to guard everything in it with the greatest secrecy. TO BE FOUND AT Xmas Fruits Washington, Dec. 6.—President Roosevelt's message to Congress was read before both branches today, and is as follows: Tokio, Dec. C.—Advices received from Port Arthur are to the effect that the Japanese bombardment of the Russian fleet there continues effective. Washington, Dec. 6.—The assembling of congress was marked by those scenes which have become familiar by frequent repetition. There were the exchanges of greetings between old acquaintances on the floors of both houses, the swapping of campaign stories and experiences and the general resemblance of the assemblage to a jolly reunion. The safety appliance law, as amended by the act of March 2, 1903, has proved beneficial to railway employees, and in order that its may be properly curried out the force of inspectors provided for by appropriation should be largely Increased. The relations of capital ami labor, and especially of organized capital and organized labor, to each other and to tiie public at large come second in importance only to the Intimate questions of family life. Onr peculiar form of government, with its sharp division of authority between the nation and the several states, has boon on the whole far more advantageous to our development than a more strongly centralized government. But it Is undoubtedly responsible for much of the difficulty of meeting with adequate legislation the new problems presented by the total change in industrial-conditions on this continent during the last half century. In actual practice it has proved exceedingly difficult, and in many cases impossible, to get unanimity of wise action among the various states on these subjects. There iyC no objection to employees of the government forming or belonging to unions, but the government can neither discriminate for nor discriminate against nonunion men who are in its employment or who seek to be employed under it. it is a very grave impropriety for government employees to band themselves together for the purpose of extorting improperly high salaries from the government. Especially is this true of those within the classified service. The letter carriers, both municipal and rural, are as a whole an excellent body of public servants. They should bo amply paid. Hut their payment must be obtained by arguing their claims fairly and honorably before the congress and not by banding together for the defeat of those congressmen who refuse to give promises which they cannot in conscience give. The administration has taken steps to prevent and punish abuses of this nature, but it will be wise for the congress to supplement this action by legislation. Unionism In Government Offices. Store St., Wlth regard to labor, the problem is no less important, but it is simpler. As long as the states retain the primary control of the police power the Circumstances must be altogether extreme which require interference by the federal authorities, whether in the way of safeguarding the rights of labor or In the way of seeing that wrong is not done by unruly persons who shield themselves behind the name of labor. If there is resistance to the federal courts, interference with the mails or interstate commerce or molestation of federal property, or if the state authorities in some crisis which they are unable to face call for help, then the federal government may interfere; but, though such Interference may be caused by a condition of tilings arising out of trouble connected with some question of labor, the interference itself simply takes the form of restoring order without regard to the questions which have caused the breach of order. In the District of Columbia and in the territories the federal law covers the entire field of government. But the labor question is only acute in populous centers of commerce, Manufactures or mining. Nevertheless both in the enactment and in the enforcement of law the federal government within its restricted sphere should set an example to the state governments, especially in a matter so vital as this affecting labor. The bureau of labor has done excellent work of this kind in many different directions. It is greatly to be wished that the department of commerce and labor, through the labor bureau, should compile and arrange for the congress a list of the labor laws of the various states and should be given the means to investigate and report to the congress upon the labor conditions in the manufacturing and mining regions throughout the country, both as to wages, as to hours of labor, as to the labor of women and children and as to' the effect in the various labor centers of immigration from abroad. In this investigation attention should be. paid to the conditions of child labor and child labor legislation in the several states. Berlin, llec. 6.—Official statistics covering twenty-six year* show a steady and noticeable decrease in the birth rate in the large cities in Germany in spite of the fact that the marriage rate is higher than in cities of less than 100,000 inhabitants and in the country. Berlin, which passed the 2,000,000 mark in December, presents the heaviest decrease in the birth rate. In the period from 1890 to 1900 it averaged 28.9 against 44.9 from 1875 to 1880. When we come to deal with great corporations the need for the government to act directly is fur greater than in the case of labor, because great corporations can become such only by engaging in interstate commerce, and interstate commerce is peculiarly the field of the general government. It Is an absurdity to expect to eliminate the abuses in great corporations by state action. It is difficult to be patient with an argument that such matters should be left to the states, because more than one state pursues the policy of creating on easy terms corporations which are never operated within that state at all, but in other states whose laws they Ignore. C S | BECAUSE • j[ - C« ti Los Angeles, Cnl., Dee. 6.—A Wellw- Fargo express ear on an Atchison, Topeka and Santa Fe overland passenger train, westbound, was entered somewhere between Needles and Daggett, arid Evan O. Roberts, express messenger, was shot and probably fatally wounded. The way safe was rifled, but the main safe, said to contain $200,000 in pension money, was not robbed, so far as known. Officers of the express company say the robber secured about $400 and that the main safe was not opened. f At this season of the lyar the demand for warm and serviceable hosiery and underwear steadily Increases. His last official duty was as assistant attorney geheral for the post office department, from which office he was removed last year became of his indictment, together .with his nephew, Harrison J. Barrett, on a charge of conspiracy in connection with the use of the mails by certain alleged getrich-qnlck concerns. On this charge he was acquitted by a jury. Conductor Hawes opened the door of the express car at Daggett and found Messenger Roberts lying on the floor semiconscious. The contents of the rifled safe were scattered about the car. Roberts was so seriously wounded that he was unable to tell much about the robbery. He said that he had discovered some one on the blind baggage shortly after the train left Needles and had been about to open the door when a man, whom he took to be a negro, broke open the door and enteved. Mr. Tyner was born in Broolivllle, Ind., Jan. 17, 1820. He had been identified with the postal service most of the time since March, 1801, when he was appointed a special agent in the postoffice department. They have under no circumstances the right to commit violence upon those, whether capitalists or wageworkers, who refuse to support their organizations cr who side with those with whom they are at odds, for mob rule is intolerable in any form. Perjury Charged Against Baltimorians. Baltimore, Dec. 6.—Ten persons, residents of Baltimore, have been arrested on indictments by tie federal grand Jury on the charge of false swearing in connection with applications for naturalization papers. Two of them, Jacob Keiner and Charles Eisensteln, confessed their guilt and asked United States Judge Morris for mercy. It is alleged that a large number of foreigners were .taken to "Westminster, Aid., on Oct. 10 last and received naturalization papers after making the necessary oaths as to their residence in the United States, etc. BOYS' STOCKINGS. The ever increasing casualty list upon our railroads is a mntter of grave public concern and urgently calls for action by the congress. The passage of a law requiring the adoption of a block signal system has been proposed to the congress. I earnestly concur in that recommendation and would also poilit out to the congress the urgent need of legislation in the Interest of the public safety limiting the hours of labot for railroad employees in train service upon railroads engaged in interstate commerce and providing that only-trained and experienced persons be employed in positions of responsibility connected with the operation of trains. The Wells-Fargo company was expecting a large shipment of United States pension money totaling $200.- 000, it is said, and it is possible that this shipment may have been on the train. It is known that the local officials were greatly exercised over the robbery and at Barstow placed a substitute messenger on board the car with orders to guard everything in it with the greatest secrecy. TO BE FOUND AT Xmas Fruits Washington, Dec. 6.—President Roosevelt's message to Congress was read before both branches today, and is as follows: Tokio, Dec. C.—Advices received from Port Arthur are to the effect that the Japanese bombardment of the Russian fleet there continues effective. Washington, Dec. 6.—The assembling of congress was marked by those scenes which have become familiar by frequent repetition. There were the usual throngs of fashionably gowned women In the balconies and the great masses of flowers on desks of favorite members. There were the exchanges of greetings between old acquaintances on the floors of both houses, the swapping of campaign stories and experiences and the general resemblance of the assemblage to a jolly reunion. The safety appliance law, as amended by the act of March 2, 1903, has proved beneficial to railway employees, and in order that its may be properly curried out the force of inspectors provided for by appropriation should be largely Increased. This service lias passed the experimental stage and should receive generous recognition by the congress. New York. The relations of capital ami labor, and especially of organized capital and organized labor, to each other and to tiie public at large come second in importance only to the Intimate questions of family life. Onr peculiar form of government, with its sharp division of authority between the nation and the several states, has boon on the whole far more advantageous to our development than a more strongly centralized government. But it Is undoubtedly responsible for much of the difficulty of meeting with adequate legislation the new problems presented by the total change in industrial-conditions on this continent during the last half century. In actual practice it has proved exceedingly difficult, and in many cases impossible, to get unanimity of wise action among the various states on these subjects. There iyC no objection to employees of the government forming or belonging to unions, but the government can neither discriminate for nor discriminate against nonunion men who are in its employment or who seek to be employed under it. it is a very grave impropriety for government employees to band themselves together for the purpose of extorting improperly high salaries from the government. Especially is this true of those within the classified service. The letter carriers, both municipal and rural, are as a whole an excellent body of public servants. They should bo amply paid. Hut their payment must be obtained by arguing their claims fairly and honorably before the congress and not by banding together for the defeat of those congressmen who refuse to give promises which they cannot in conscience give. The administration has taken steps to prevent and punish abuses of this nature, but it will be wise for the congress to supplement this action by legislation. Unionism In Government Offices. Store St., Wlth regard to labor, the problem is no less important, but it is simpler. As long as the states retain the primary control of the police power the Circumstances must be altogether extreme which require interference by the federal authorities, whether in the way of safeguarding the rights of labor or In the way of seeing that wrong is not done by unruly persons who shield themselves behind the name of labor. If there is resistance to the federal courts, interference with the mails or interstate commerce or molestation of federal property, or if the state authorities in some crisis which they are unable to face call for help, then the federal government may interfere; but, though such Interference may be caused by a condition of tilings arising out of trouble connected with some question of labor, the interference itself simply takes the form of restoring order without regard to the questions which have caused the breach of order. In the District of Columbia and in the territories the federal law covers the entire field of government. But the labor question is only acute in populous centers of commerce, Manufactures or mining. Nevertheless both in the enactment and in the enforcement of law the federal government within its restricted sphere should set an example to the state governments, especially in a matter so vital as this affecting labor. The bureau of labor has done excellent work of this kind in many different directions. I shall shortly lay before you In a special message the full report of the Investigation of the bureau of labor Into the Colorado mining strike, as this is a strike In which certain very evil forces, which are more or less at work everywhere under the conditions of modern industrialism, became startlingl.v prominent. It is greatly to be wished that the department of commerce and labor, through the labor bureau, should compile and arrange for the congress a list of the labor laws of the various states and should be given the means to investigate and report to the congress upon the labor conditions in the manufacturing and mining regions throughout the country, both as to wages, as to hours of labor, as to the labor of women and children and as to' the effect in the various labor centers of immigration from abroad. In this investigation attention should be. paid to the conditions of child labor and child labor legislation in the several states. Berlin, llec. 6.—Official statistics covering twenty-six year* show a steady and noticeable decrease in the birth rate in the large cities in Germany in spite of the fact that the marriage rate is higher than in cities of less than 100,000 inhabitants and in the country. Berlin, which passed the 2,000,000 mark in December, presents the heaviest decrease in the birth rate. In the period from 1890 to 1900 it averaged 28.9 against 44.9 from 1875 to 1880. When we come to deal with great corporations the need for the government to act directly is fur greater than in the case of labor, because great corporations can become such only by engaging in interstate commerce, and interstate commerce is peculiarly the field of the general government. It Is an absurdity to expect to eliminate the abuses in great corporations by state action. It is difficult to be patient with an argument that such matters should be left to the states, because more than one state pursues the policy of creating on easy terms corporations which are never operated within that state at all, but in other states whose laws they Ignore. I believe that under modern industrial conditions it is often necessary and even where not necessary it is yet often wise tiiat there should be organization of labor in order better to secure the rights of the individual wageworker. All encouragement should be given to any such organization so long as it is conducted with a due and decent regard for the rights of others.
