Civil Engineers, under the date of January 26, 1951, as revised, subject to the conditions and reservations hereinafter set forth. SECTION 2. The Borough does not at this time accept dedication of Rutgers Avenue extending northwardly from Fair- view Road to the southwesterly side of Juniata Avenue, extended. Said portion of Rutgers Avenue Is not now physically open, and the Borough has no present intention of opening same, but reserves its easements over, across and through same for sewers, sidewalks or other purposes as authorized by prior deeds of dedication. SECTION 3. The Borough reserves the right to require construction of standard sidewalks where same do not now exist and all other rights granted to it pursuant to agreement ' with Swarthmore Gardens, Inc., dated August 14, 1951, recorded at Media in Deed Book 1532, page 259, and agreement with William Clarke, Jr., dated November 18. 1962, recorded at Media in Deed Book 1674, page 142. and all collateral agreements and bonds of indemnity in connection therewith. SECTION 4. Except as herein provided, all of said roads, streets and avenues as or the respective widths and distances shown on said plan' are hereby accepted as and for public highways of the Borough. MARIETTA AVENUE AND JUNIATA AVENUE AS SHOWN UPON PLAN OF PROPERTY FOR SWARTHMORE GAR. DENS, INC.. PREPARED BY DAMON AND FOSTER. CIVIL ENGINEERS. UNDER DATE OF JANUARY 26. 1950. AND PURSUANT TO DEED OF DEDICATION OF SWARTHMORE GARDENS. INC.. ET AL. DATED APRIL 4. 1952. SUBJECT TO THE RESERVATIONS AND CONDITIONS IN THIS ORDINANCE SET FORTH. THE COUNCIL OF THE BOROUGH OF SWARTHMORE DOES ORDAIN: SECTION 1. Pursuant to deed of dedication dated April 4. 1952, recorded at Media in Deed Book 1682, page 266, made by Swarthmore Gardens, Inc., et al, the Borough of Swarthmore hereby accepts as public streets of tbe Borough Michigan Avenue. Fairview Road (formerly Leiper- ville Road), Rutgers Avenue, Strath Haven Avenue, Drew Avehue, School Lane, Bryn Mawr Avenue, Westminster Avenue, Marietta Avenue and Juniata Avenue, as more particularly shown on the Plan of Property for Swarthmore Gardens, Inc., prepared by Damon and Foster. Civil Engineers, under the date of January 26, 1951, as revised, subject to the conditions and reservations hereinafter set forth. SECTION 2. The Borough does not at this time accept dedication of Rutgers Avenue extending northwardly from Fair- view Road to the southwesterly side of Juniata Avenue, extended. Said portion of Rutgers Avenue Is not now physically open, and the Borough has no present intention of opening same, but reserves its easements over, across and through same for sewers, sidewalks or other purposes as authorized by prior deeds of dedication. SECTION 3. The Borough reserves the right to require construction of standard sidewalks where same do not now exist and all other rights granted to it pursuant to agreement ' with Swarthmore Gardens, Inc., dated August 14, 1951, recorded at Media in Deed Book 1532, page 259, and agreement with William Clarke, Jr., dated November 18. 1962, recorded at Media in Deed Book 1674, page 142. and all collateral agreements and bonds of indemnity in connection therewith. SECTION 4. Except as herein provided, all of said roads, streets and avenues as or the respective widths and distances shown on said plan' are hereby accepted as and for public highways of the Borough.
