Trust lawsuit continues By FRANK TIBDNI Staff writer A judge hearing the civil suit of Sewickley Heights Trust shareholder Hon Rose Jr. against its trustees and the Borough of Sewickley Heights has been sent over to Orphan’s -.Court- ;/<-• . . ■ / Judge'Eugene Strassburger, of Allegheny County-Court of Common Pleas Civil Division, ordered- that the case be refer-' red to Judged, Warren -Watsoa for disposition. . Jeff Ludwikowski, an attorney for Rose, feels the switch does not favor either party, hut that the decision was made because he believes it is in Watson’s jurisdiction. On June 13, Sewickley Heights Trust trustees G. Whitney Snyder, JbhnC. Oliver HI and Stephen E. Nash petitioned the Orphan’s Court for a declaratory judgment confirming the trustees’ authority to donate the property to the borough, 'Watson ruled in the trustees’ favor on March 6. Before Watson rendered that '-decision, Rose filed the civil suit against the borough and the trustees. ' On June.l, Orphan’s Court ' judges Watson,' Nathan Schwartz and Robert Kelley will hear the/'-exceptions Iteeo filed to the declaratory judgment. The majority of the shareholders would like to donate the land to the borough for use as a public park, but Rose would like to see it developed. - Rose believes the 503 acres, supposedly worth $10-15 million, should be sold not only to benefit the shareholders, tat also to produce tax money hr Sewickley -Heights Borough and Quaker Valley School District. Tie land is the woodlands near Sewickley Heights Park It site between Little SowieMoy Creek Road and Feta Mow Road in the northern past ef tfeo borough.
