Photo by Ed Galieic Jr. ■ actions ruled in tower controversy If Sean Kline Staff wlter ■ ; Notch a win in the belt of Sswickfey Borough in the battle to be or not to be the site of a proposed 250-foot communications tower. ’ “Regardless of how individual council members felt on the tower isstte> whether it was pro or con, the key here is that the action taken by council has proven to be legal and above board,” said Kevin Flannery, Sewickley Borough manager. “The borough is ttewhmer,” In April, sec Sewickley Valley residents, one from Sewickley and five from Sewickley Heights, Bled salt against the borough and Crown Communications alleging that the lease agreement between Crown and Sewickley was invalid for several reasons. There were seven counts against the borough and frown, none of which were found valid by Allegheny County Court of Common Fleas Judge R. Stanton Wettick Jr. - • The residents contended that the borough violated Pennsylvania’s Sunshine Act, the Borough Code, Expressed and Implied use Reservation, Public Contractor's Bond law, Prevailing Wage Act and the Steel Products Procurement Act in its dealings with Crown, Judge Wettick found in favor of the borough on all seven counts. “In my discretion, I do not find to be invalid the action of council and the mayor taken at the public meeting of the borough council on Sept Id, 1995, to enter into a lease with Crown,” said Wettick in his decision regarding the count against the Sunshine Act violation. “In summary, from the outset, the public was aware of the nature of the construction project, the location of the proposed tower, and the nature of the transaction... “Before the final vote, the members of the public who opposed the project had a full opportunity to seek to persuade those council members who favored the project that they should reverse their position.” The plaintiffs charge ef violations of the . borough code were unfounded because the : ■' ...'■— .....
