A Recent decision in the Pennsylvania Supreme Court is of interest to bicycle riders who may have occasions to cross railroad tracks. It is the case of Robertson against the Pennsylvania Railroad Company, aud is reported | in 1 American Negligence Reports It appears that damages were claimed for I the death of a person while crossing a rail* road track, but the plaintiff was nonsuited in ; tho Common Pleas. The din-eased was riding a bicycle, aud when he came to the railroad, at a point having four tracks, a freight train was passing, for which he had to wait. He did not dismount, but made what was called a "bicycler's stop," by circling on his wheel round and round, at a distance of from live to ten yards from tho track, aud when the train passed bo started across without dismounting, and was struck and killed h> a train coming j in the opposite direction on another track. On appeal to the Supreme Court the .judg ment of nonsuit was affirmed. Justice Mitchell holding that it was the duty of the deceased to stop aud dismount, and refusing to entertain the proposition that the circling round and round constituted a legal stop. "Riding round and round in large or small circles, waiting for a chance to shoot across, is not a stop at all, either in form or substance. Considering the easo of dismounting and the control of tho rider over his instrument," continues the decision, "a bicycler must, under 'all ordinary circumstances, be treated as subject to the same rules as a pedestrian." The Judge says further that "the rule to be applied requires that a bicycler must dismount, or, at least, bring bis wheel to such a stop as will enable him to look up and down the track and listen, in the manner reqtired of a pedestrian." letters of administration having been granted the undersigned on the eiitate of Jobu (1.
