Warner Miller." A man in one of the boxes arose, and interrupting Mr. Small, requested that he thereafter refer to Mr. Miller as "the dishonorable" Warner Miller. Instantly nine tenths of the audience began to hiss, and there were cries of'put him out." Many rose and left the hall. Small said he would not refer to Warner Miller as he had been requested, but would leave him where he had found him. When the speaker mentioned Mr. Miller's name cgain he bad to stop, for a storm of applause followed that lasted for some time Canes and nmbrellas were pounded on the floor, and some folks even went so far as to oheer. WvnavttLK, Va., Not. 39.—Thank*- firing Day *n otUlmUd in thia quiet little town by a nob ofSOC armed man entering the Jail and releasing Wayman Sutton, a white man who wae to ham been hanged tor the murder of Peter HarrelL It waa restored hfere yesterday that a crowd of two hundred or more had been organised to eome to town and take the doomed man out of the jell. About two o'clock thia morning a noiey demonstration aronnd the walle of the prison warned the officers of the prison of the presenoe of the rescuing party. The death watoh explained to Sutton the meaning of the unusual noise. His remark waa: ■'My God, jailer; pleas* don't leave them in." Sntton expected the party and his fear seemed to be that the jailer might prevent them from forcing themselves to his cell. The members of the resetting party were masked and well armed. They first demanded admission from the jailer, who refused to let them in. The men were determined and in one mlnnte the prison officials were overpowered, the front doors knocked in with sledge-hammers and the hall packed with desperate men. The jailer refused to tell where the keys to the cells were, but one of the party found them hidden in the jailers private room. All of the prison officials were then lockod up and the convicted murderer's coll door opened. Sutton was told to dress in a hurry and get oft before arousing the town. Without stopping to put on his shoes and with the scantiest possible apparel the doomed murderer was carried off. The mob, most of whom were mounted, carried him to the mountains, where all trace of them have been for the time-being lost. Peter Harvell was mordered in March, 1887, and the evidence, all of wliiili was circumstantial, pointed to Sutton anil his father-in law, Morgan Pendleton, asihe murderers. Harvell's house bad been previously destroyed by an incendiary and himself badly wounded by a would-be aasassin, and he was still suffering from the wound when murdered. Pendleton and Sntton were seen in the neighborhood of the honse previous to the murder, and the general impression in the neighborhood was that they had been hired to kill him. The sheriff of the oounty some time ago received a letter from Pendleton, Sutton's father in-law,dated Thinto,Marion oounty, Kentucky, in whioh the writer eonfesaed that he murdered Howell. In hia lettor Pendleton said : "I was inspired by God to remove Mr. Harvell, and I did so by putting two bullets in my gnn. Sutton is as innocent of the crime as the angels in heaven." This letter was submitted to Qovernor Lee. Sutton was arrested in Indiana last June at.d brought back to Wytbeville where his trial took place. He waa convioted of mnrder in the first degree at the Maroh term of the Wythe county Court and the Cirouis Court refused to rehear the oase. The matter waa then taken before the State Supreme Court of Appeals- arid the judgement of the lower tribunals were sustained. The friends of the condemned man appealed to Governor Lee for clemenoy, and he, after an exharoive review of the testimony, deolined to interfere. It does not appear that be placed any confidenoe in the alleged letter from Pendleton, but laid down the broad preposition that the Executive his no right to interfere with or set aside the action of a competent and intelligent jury. Since bis incarceration Rntton has been visited by many friends who dy not believe be is guilty, as the conviction wts obtained solely on circumstantial evidence. Mnrder nml NnlrMp. m B. The hall was completely tilled, and it was evident that almost everybody present, was an admirer of Warner Miller. It was a prohibitionist, presumably, who interrupted. TYR. B. C.
