That the Secretary gf War, bo, and ho is heroby-irathorized anil direoted to negotiate ivith a. respon.sible party to buibl and operate a telegraj)h line from Yanetou, Dakota Territory, tn Fort Ran¬ dall, Dakota, .and thence to Fort Sully, if, in the opinion of tho Seeretary of war, the public service demands such exten¬ sion. That if the revenues of tho Post Office Department shall bo insufficient to\ meet the appropriations made by this aet, then the snm of threo million nine hun¬ dred and sixty-nine thousaud three hun¬ dred and eighty-three dollars, or so much thereof as may bo necessary, be, and the samo is hereby, ajijiropriated, ta bo paid out of any nioney in the treasury not oth¬ erwise appropriated, to supply deficiencies in tlio revenne nf thc Posti-Offios Depart¬ ment for fhe year onding June thirty, eighteen hundred .and seventy-two- Sec. 4, Tliat all bidders, upon CA-ery mail route, for the transportation of mails upon the same, shall hereafter accompany their bids (where they exceed flve thousand dollars) wifh a certified check or draft, Jiayable to tde order of the Postmaster General, of some reliable banking hou.se or lianking institiition, which check or draft shall not be less than five per cent, on the amount that they would receive in any one year under such bid. In ease any bidder, on boing aAvarded any such contract, shall fai! to enter into good and suffieient bonds to faithfullv c:irry oat such contract, such bidder or bidders shall f jrfeit tbo amount so deposited fo the l'uited States, for the nse of the Post Office Dejiartment; other¬ wise, such draft or cheek, so deposited, shall lie returned fo the bidder, to whom it belongs. Sec, 5. That it sh:ill be unlawful for the Newport and Cincinnati Bridge Company, or any other company, or person, to pro¬ ceed in the erection of the bridge now be¬ ing constructed ovor the Ohio river from the city ot Cincinnati, Ohio, to the city of Newport, Kentucky, and the approaches thereto, unless the said bridge shall be so constructed that the channel span of four hundred feet, as now located, shall hve un¬ der said span a clear headway, at low wat¬ er, of one hundred feot below auy point of said channel span, and in such case no draw shall be required in said bridge; all the other spans of said bridge, Avhich cover the Ohio river, to low-water mark, shal! have a clear headway of net less than sev¬ enty feet iiboA-e low-wator mark, and the other spans of the said bridge, extending to each shore, may be made of less eleva¬ tion tban seventy feet above loAV-watcr mark to accommodate a regular grade for the ap- jifroaclics to said bridge. .\nd when the foregoing rcfpiircments shall have been complied Avith by the said Newport and Cincinnati Bridge Companj, the location of said bridge, its structures, and approach¬ es, shall thereupon be deemed to be legal¬ ized, and declared to be lawful gtrnctnres, and shall be reoognized and known as a post route. The plans for changes in such bridge, made necessary by this act, shall be submitted by said company to the Sec¬ retary of War for his approval. And, in the event of the Bridge Company making the changes provided for in this act, it shall be lawful for the said company, after they shall have made the changes in said bridge, and the approaches thereto, as herein provided, to tile their bill in equity against the United States in the circuit court of the United States for the southern district of Ohio, and full jnrisdioticoi is hereby conferred upon said court to de¬ termine : first, whether the bridge, accor¬ ding to the plans on which it ha» progress¬ ed at the passage of this act, has been con¬ structed so as substantially to comply with the provisions oflaw relating thereto; and, second, the liability of the United States, if any there be, to the said company by reason of the change by this act reqnired to be made; and if the said court shall de¬ termine that the United States is so liable, and that said bridge was so being built, then the said court shall further ascertain, and determine the anionnt of the actual and necessary cost and expenditures rea¬ sonably required to be incurred in making the changes in the said bridge and its ap¬ proaches as hereby authorized or required, in excess ofthe cost of building said bridge and appoaches, accordiog to the plan pro¬ posed, before the ehjJhges required by this act to be made. And the said court is hereby further authorized and required to proceed therein ti final decree as in other cases in equity. And it shall he lawful for either party to the said suit to appeal from the final decree of the said circnit court, to the Supreme Court ofthe United States as in other cases, and the Supreme Court shall thereupon proceed to hear and dertermine the said case and make a find decree therein, and thereupon,ifsuch deerce shall be in favor of said company, the Secretary ofthe Treasury ofthe United States shall, out of any moneys in the treas¬ ury not otherwise appropriated, pay to the said company such sum of money as shall by the said Supreme Court be so decreed to be paid to the said company: Provided, nevertheless. That no nioney shall be paid by the Secretary of the Treasury to the said company until the Supreme Court of the United States, npon appeal taken as aforesaid, shall render a final decree in the case in favor of said company. Be it enacted by the Senate (tnd Houte of Representatives of the United States of A'merica in Congress assemhled, That the grant of lands made to the State of Ala¬ bama by the act of Congress approved June tbree, eighteen hundred and fifty- six, entiitled '-An act granting pablic lands, iu alternate sections, to the State of Alabama, to aid in the construction of cer¬ tain railroads in said State," to assist iu the building ofa railroad from the city of Montgomery, Alabama, to some point on the Alabama and Tennessee State line, in the direction of Nashville, is hereby revi¬ ved and reuewed for the use and benefit of thc South and North Alabama Railroad Company, subject to all the conditions and restrictions contained in the act referred to, and subject to the further limitation, that if the said railroad is not completed within three years from the pas:«ige of this act no further sale shall be made for the benefit of said road, and thc lands unsold shall revert to the United States : Provid¬ ed, That the lands granted by the act here¬ by revived, except mineral lands, shall be sold to actual settlers only, in quantites not greater than one quartar section to any one purchaser, .dud for a price not exceed¬ ing two dollars and fifty cents per acre. Sec, 2, That the right, power, and au¬ thority is hereby given to the company building the aforesaid railroad to take from the public land, adjacent to the lines of said railroad, earth, Btone,« and other materials for the coustructien thereof; and the right of w#y is hereby granted to the extent of one hundred feet iu width on each side of said railroad where it may pass ever the public lands, including'all neces¬ sary grounds fur stations aod structures connected therewith, not exceeding forty acres at any one station.
